38. Try a “reckless endangerment” approach, I.e. “they should have known” that a male player is stronger than the usual female player. Therefore the school system “should have known and or anticipated enhanced risks to a girl player’s safety”.

That wouldn't work because it would also have to apply if there were girls on the team that were much bigger stronger that other girls, and they are out there.

That's why they should have been wearing protection regardless.
