No, not case closed. Like it or not, politically motivated or not, the charges relate to actions taken after he was president. The mere fact that he was president and chief executive does not mean anything he took with him after he left office was automatically declassified. It’s different to argue that he could legally have them since he retained his security clearance and under the PRA he is to have access to his presidential records after leaving office. But that is not the same as them being declassified. He could have declassified before he left office, but he is on tape talking to an aide about getting the documents in question declassified, and how he could no longer do it because he wasn’t president.
I don’t think presidents have security clearances per se. And he doesn’t have a security clearance now. He could be given access by the current president if he has a need to know or, with permission, for his memoirs or library.
But, yes, the indictment deals with actions after Trump left the presidency, and it doesn’t appear to matter if the documents are classified or not. The indictment is saying that the government asked for the documents back, but President Trump hid them, lied about having turned everything over, and possibly sharing documents in ways that endanger national security.
Everyone needs to read the indictment so there can be informed discussion rather than just saying words.
100% BS.
One question is whether Mark Milley leaked classified information to the press or book writers claiming he stopped Trump from invading Iran. The document was allegedly the plan Milley presented to Trump on invading Iran. If this is audio, not video, we don’t know if Trump allowed it to be read or just “showed it” as a prop.
They are saying Trump was carelessly storing these documents while not charging him that way to avoid cases against Biden, Pence and the rest. They are saying the infamous bragger Trump should be taken literally that he didn’t declassify rather than him gaslighting those present for narrative effect.
If he caused the documents to go to Mar-a-lago while president the issue of him not being president is mooted. That means he still had the absolute and unreviewable authority to declassify documents going with him as records of his presidency.
