I am working as swiftly as Texas law allows regarding the pardon of Sgt. Perry.
Article 4, Section 11 is very clear. Gov. Abbott can't pardon until the Board of Pardons recommends it. Not every State works the same. The knee jerk, clownish reactions to headlines, without knowing what the facts are, really need to stop.
Glad to hear of Gov Abbott’s intentions.
Aren’t they working on legislation to ensure local DAs don’t undermine State Law? I know they are in session until May 29.
I know it had to do with undermining anti-abortion laws but I am sure it could be cross-applied.
I have read my state's constitution, but not the other 49 - how many people have?
Gov Abbott could have put out a statement from his office as soon as the sentence was read. How did he not know there would be a Patriot outcry from around the nation?
LOL!
You are absolutely correct. Texas was founded by people trying to get away from too much government. By design, the Texas Governor has very limited powers. That is also why the legislature only meets every other year and most substantive laws require a Constitutional Amendment by popular vote.
Under Article 4, Section 11, of the Texas Constitution:
"In all criminal cases, except treason and impeachment, the Governor shall have power, after conviction or successful completion of a term of deferred adjudication community supervision, on the written signed recommendation and advice of the Board of Pardons and Paroles, or a majority thereof, to grant reprieves and commutations of punishment and pardons ..."
This, entirely this.
But, as long as he started doing something of substance at once, letting Twitter wait is no sin.
Find a reason to charge the Soros DA, jail him pending trial and put into the general population. The problem will be resolved.
The lead investigator has issued an affidavit saying the DA’s office limited and removed much of his testimony to the grand jury, particularly exculpatory evidence.
This alone should get Perry a new trial.
“Rob_Henry” Gov Abbott is getting in the fight... which is a good thing. The prosecutor needs to be referred for disbarment...
Very good news. Pardon this man and give him his weapon back.
In all fairness, Texas does have a really long Constitution, almost 300 pages long depending on the font and formatting used.
No, he shouldn’t have to go through another trial. At this point he just needs a pardon.
The DA should be charged with false imprisonment or something.
Barring that maybe have a mostly peaceful protest around his car. Let about 40 people beat on the hood while somebody else points an AK-47 at him.
Any links to that info?
This has been quite a learning experience!
It is a shame that I had to go search to find that Abbott appoints the board.
That would be easily arranged and make for some good TV
Abbott could have a friendly conversation with the chairman of the Board of Pardons.
The interesting thing - the affadavit was issued 18 months ago, yet the jury still found Perry guilty.
“You are absolutely correct. Texas was founded by people trying to get away from too much government.”
Let me get this straight: The reason this tragic abuse of government power has gone unchecked for nearly three years - is because Texans don’t want the government to have too much power.
Got it. /S
