One of the things I often have to remind people about, including lawyers who should know better, is that each state has its own unique laws and procedures. What is no big deal in most places may be a fiasco in another.
For Donald Trump, the upcoming New York "falsifying business records" charge he may be facing would be laughed out of court almost everywhere, as no money was stolen and no harm to anyone seems to have been done. Unfortunately for him, he is stuck in the Empire State. And as unfair as it sounds, I think Mr. Trump is in some real trouble.
The plan the Manhattan D.A. has is to convict him on a trivial offense, then hope a vindictive judge will throw the book at him. This happens all the time to suspected mafiosi in New York courts, and it may be what's going on here.
Start with the supposed two-year statute of limitations on misdemeanors underlying the prosecution. It is expected that D.A. Bragg's office will overcharge Mr. Trump, with several felonies, in part just to get around the two-year limit. But that may not even be necessary. Unfortunately, as many people are now discovering, the statute of limitations tolls for the time a defendant resides out of New York State, as Mr. Trump has the last six years. So the statute of limitations most likely won't come into play.
Then, thanks to the persistence of organized crime in New York, there has evolved an astonishingly wide theory of misdemeanor "intent to defraud," developed in such organized crime cases as People v. Kase.

This is also where the Trump Organization convictions for fraud last year will come into play. These can used by a judge to pile on to Trump himself at sentencing, making him out to be the equivalent of an organized crime boss, to justify a harsh penalty.
I don't think Trump would get the maximum — one year in county jail — but a sixty-day term on Riker's island is possible, depending upon the judge. Even without a period of incarceration, the conditions of Trump's probation could be onerous. Just requiring that he remain in New York for a year or two would effectively end his presidential campaign.
Simple...just start finding Dems to indict with a grand jury in red areas. Time to fight fire with fire.
The vicious, terroristic left want Trump in confinement just long enough for him to “commit suicide.”
that’s what appeals courts are for.
First, I don’t believe Trump will ever be charged for anything. Second, even if he is, I predict hung jury most likely outcome. And even on the off chance he was convicted, the penalty would most likely be a fine. And even then it will be appealed no matter what and eventually overturned.
Matt Walsh made exactly this same recommendation in his show the other day.
I really don't see any other solution. In a real war, the side which stops firing isn't going to be anywhere near a victory.
Boris Johnson is still fighting charges over a party he held during Covid.
I suspect that one of the reasons for DeSantis going full Globalist/Neocon yesterday, at least regarding Ukraine, is that he knows Trump is likely to be prevented from running...so he figures he’s the ‘default candidate’ and can now say and do as his money-masters demand.
Bummer for him if true, as he’ll likely never make it on the ballot in November 2024, since the first Primary is still a year away and there are OTHERS, besides Trump, who are willing to stand up to those monsters.
I don't think this is so clear. For 4 of those six years (or was it 7 years) Trump was the President of the United States who was immune to prosecution except thru impeachment and removal which did not happen. There is no case law that I know of that is clear in determining that the timer stopped and then restarted based on the defendant being immune from prosecution for a time as the chief executive of the entire nation.
And everyone will be wearing these images on t shirts supporting Trump and a return to American fair jurisprudence
Many certainly will...but not everyone. Remember, there’s 20% of voters who are said to be “independents”.

Absolutely, 100% correct. Just be sure those Dems are top shelf. Go after the big boys (and big gals). Biden, Hillary, Harris, etc. It can be done.
The “progressives” are fighting bare-knuckle, and for keeps. The GOP just whines and complains. It’s not hard to see who will win such a contest.
We are down to the desperate measures here.
They are going to kill him.
Not so easy for the ones you list because it needs to be someone that has had significant activity near red counties. Mark Kelly, Jon Tester, Raphael Warnock, Jon Ossoff might be good targets. It would be enough to get the attention of Democrats at least.
It is enlightening just to see what extremes these people will go to just to Stop Trump.
They’ve been after him for 7 years. He’s been running circles around them the whole time. One day, the Trump haters are finally going to be forced to grow up and move in to adulthood. Then, they will finally realize how much time out of their lives they wasted chasing him for a bunch of crybaby princesses who wasted a whole day in November 2016 sitting on their asses in Javits Convention Center making goo goo eyes at one another and waiting for Hillary Clintoon to come crashing through the glass ceiling followed closely by her trusty companion, Huma, carrying a Chip Ole! Burrito bowl and her daughter, Chelsea, jogging nearby.

If Trump gets to NY jail, does it means he has to pay NY state taxes again?
The New York deal ain’t gonna happen. It’s a feignt.
The real skullduggery is going down on DC Federal court.
