The Colorado Springs shooting suspect’s gender identity will not stop the authorities from bringing in hate crime charges against them, legal experts claim.
… The suspect’s gender identity is “not relevant," Neama Rahmani, president of West Coast Trial Lawyers and a former federal prosecutor, told Insider. "Obviously the defense will want to get it in, but it’s not a defense."
"It’s certainly something that the defense would try to use, but it’s not in and of itself a bar from hate crime charges depending on what the other evidence is," Brian Levin, professor of criminal justice at California State University, San Bernardino, was quoted as saying by the Insider.
"The notion that because someone might belong to a group does not mean that some ... dispute revolving around that group membership or issue would negate hate crime charges," he added.
Meanwhile, the court has ordered that the suspect be held in custody without bail.

Perhaps the “legal experts” could explain how Darrel Brooks, now convicted killer of six White people, escaped “hate crime” charges for something that was obviously motivated by hate.
As long as he’s white he’ll be charged with a “hate crime”. Maybe he should consider self-identifying as black.

I read where the perp didn’t have much presence on social media. Unless he left some ‘manifesto’ looks like it’ll be hard to prove hate crimes. Five consecutive life sentences for murder plus add on time for assault would seem to do the trick regardless.
Well, well, this opens up all sorts of new legal avenues. So, what they’re saying is that if one member of a particular group attacks other members of that group with hate in their hearts then they can be charged with a hate crime? And, since violent crimes against persons almost always involve some degree of hate, that would make them all hate crimes?
If the gender won’t fit you must acquit.

The charge of shooting people dead in a club should always be the primary charge. Something is wrong when the main concern is whether it is a “hate crime” or not.
Now all blacks who kill blacks can be charged with a hate crime. Any FR lawyers want to chime in on precedence being set here?

The prosecutor in Colorado who decided not to prosecute him for his prior felonies bears much responsibility for these killings. This lunatic put society on ample notice that he was crazy and violent. People who are paid to enforce the law and protect society did nothing.
