Oklahoma killer executed despite lawyers’ pleas of mental incapacitation

A convicted killer in Oklahoma was executed Thursday despite his lawyers arguing he was mentally ill and unaware of his imminent death.

Benjamin Cole, 57, was pronounced dead at 10:22 a.m. local time at Oklahoma State Penitentiary in McAlester, attorney Tom Hird told The Post.

Cole was sentenced to death in 2004 for the Dec. 20, 2002, murder of his 9-month-old daughter. CNN reported after the baby’s cries interrupted Cole’s video game, he broke her spine.

So?

He killed his baby girl.

Child killers should be executed.

He lived 20 years after he murdered his wee girl ???

She would be about to graduate from college by now ...

About time he was punished for what he did to her ...

I would settle for life - no parole - until you die of old-age - in prison after a speedy trial in a lot of these cases. But many times that does not even happen.

His lawyers pleas were obviously heard by the court and 20 years worth of appeals as well and this was the decision that was lawfully made by a large group of jurors and more than a few judges.

Be done with it!

Benjamin Cole’s last photo has to be one of the saddest portrait pics I have ever seen. He got what he deserved, but it should have been carried out within two years of conviction.

One look at him, I am lead to believe Benjamin was already locked into a Hell of his own making. It takes a certain type of person to work as a guard on Death Row.
Doing this as a long term gig, I would not be interested or emotionally qualified.

There are lots of cases of mitigating circumstances that do not fall under “too much compassion.” That is why the law distinguishes between killing and murder.

And murder is subdivided into degrees, first degree being premeditated and intentional; second degree being in the heat of passion, spontaneous; and third degree, that only exists in three states, where violence was intentional, but homicide was both unlikely and unintentional.

And then there is manslaughter. Possibly first distinguished from murder in the 7th century B.C. But with the rather vague definition of “homicide considered by law as less culpable than murder.”

Manslaughter varies a lot between jurisdiction, but most commonly is defined as either:

Justifiable
Voluntary (sometimes including assisted suicide)
Involuntary
Constructive
Criminally Negligent
Vehicular and Intoxicated

That was the argument liberals used for a long time. Then their liberal parole boards let them out or guys like Bundy escaped and killed again. We have done this dance forever.

He would be quite "aware" of his death if they had killed him the way he murdered her...bending her back until her little spine broke. Instead he was given numbing agents and died peacefully.

So he gained 20 years of life.

Victims don’t get that extension of life. Theirs are ended by the judgment of the murderer. Some live a few hours or a few seconds and the agitated killer shoots or stabs them suddenly.

We give far too much consideration to the criminals and none to the victims. That is sick.

I wouldn't.
Especially for a child killer like this one. Execute hims swiftly and send him to hell.
