Trump to Hannity: Presidents can declassify documents 'by thinking about it'

Presidents can declassify documents on a whim, even just by "thinking about it," former President Donald Trump told Fox News' Sean Hannity on Wednesday.

Trump appeared on Hannity's show to discuss the ongoing federal investigation into classified documents found in Trump's Mar-a-Lago home during an FBI raid.

"Is there a process? What was your process to declassify?" Hannity asked.

"There doesn't have to be a process, as I understand it," Trump responded. "You know, different people say different things, but as I understand it there doesn't have to be."

"If you're the president of the United States you can declassify just by saying: ‘It’s declassified.' Even by thinking about it," he added. "There doesn't have to be a process. There can be a process, but there doesn't have to be. You're the president, you make that decision…I declassified everything."

I challenge any person who believes this to find a court case where this was presented.

Whoever is Trump's lawyer needs to be fired. This is nonsense stuff.

Time to hire attorneys based on intelligence rather than cup size.

The USSC has ruled that the POTUS can declassify documents if he chooses to, just by saying it, and he doesn’t need permission. You should know by now that Trump is prone to exaggeration, so I’m wondering why you’re making a big deal about the exact verbiage he used.

As far as the MSM-Democrats are concerned, PDJT was never actually President, so he was never legally entitled to declassify anything.

A POTUS is the ultimate classification authority. Whatever he deems classified, is classified. Whatever he deems to the contrary, is so. He is the plenary originator of the classification system.

No authority is above POTUS on this matter.

And ABSOLUTELY NO AUTHORITY CAN PROSECUTE HIM FOR A VIOLATION OF CLASSIFICATION LAWS.

If he says they were declassified docs as soon as he took them, nobody can say otherwise.

As long as he deemed them declassified while he was still POTUS.

Who could possibly prove otherwise?

I don’t think any attorney told him that nonsense. He probably just misspoke and didn’t accurately explain what the lawyers told him.

The more likely explanation is that merely taking an action to remove classified materials to a public — or even somewhat unprotected — domain constitutes a “declassification” process by definition. As the President of the United States he doesn’t have to explain any of this to anyone … because the original classification of the materials is established entirely within the executive branch of the U.S. government.

There is no need for a “precedent.”

The President of the United States is not subject to the authority of anyone else in the U.S. government when it comes to matters that are the responsibility of the executive branch of the Federal government.
