Federal judge to decide on legality of handing out water, food to voters waiting in line at polls

ATLANTA — A federal court judge could soon decide if Georgia’s ban on passing out food and water to people waiting in voting lines is unconstitutional.

A hearing was held Monday to take up the issue.

Channel 2′s Richard Elliot learned Monday that Georgia’s Secretary of State is promising to defend that law all the way to the U.S. Supreme Court.

The issue dates back to the June presidential 2020 primary. Channel 2 Action News was out at the Fanplex polling place in southeast Atlanta, where a line stretched around the block, and it was a sweltering day.

Elliot saw groups passing out water and snacks to voters and encouraging them to stay in line.

More than six months later, the Georgia Legislature passed the controversial Election Integrity Act, which, among other things, banned anyone from passing out food and water to anyone in voting lines.

Republican lawmakers worried that it ventured dangerously close to illegal electioneering and could be abused by certain groups who could use that loophole to campaign for their candidates.

In Pennsylvania poll pigeons can pass out anything they want so long as they stay 10 feet away from the out doors of the polling place.

Tablets, hand cards, emory boards, water bottles....WTF difference?

the process.

Men standing on the steps with clubs making sure people voted for Obama got a pass by the DOJ. Hard to imagine handing out food and water is problematic, but then everybody is judged by a different standard.

In WV in the 1960 Democrat primary, county sheriffs (all democrat) handed out whiskey for JFK votes. That’s how Humphrey was defeated here. It’s said the JFK primary victory here was the impetus that allowed JFK to get the Rat nomination.

So, there’s fine old tradition of food & drinks in Rat politics.

The rule is no handouts within 150 ft of the polling place by political parties. This is a big nothing. Dims must be worried.

Yep. My state is like that as well, they post large signs and sometimes mark a temporary line on the ground. Before the line you can have as many signs as you want, talk to voters, etc.

IIRC, in the legislation, it permits the city/county to have water stations set up.

It amazes me how all these cities have hours long wait times. I currently live in a city of about 55k people and never had to wait for more than 5 minutes to check in and maybe another 5 mins to fill out a ballot and put it in the machine. I’m usually able to park, vote and leave in 10 minutes, maybe a bit linger in a presidential election.

I am a Judge of Elections in PA.

More than 10 feet away from the outside door to the polling place (or bottom of the ADA ramp) you can hand out anything you like: water bottles, shots, blunts, whatever.

Inside that line, you will meet my Constable. And he is armed.

If you’re smart enough to vote, you’re smart enough to bring your own water. However, November election days aren’t usually sweltering in most of the US. Any other election, as in a primary, has very few voters showing up so long lines are unlikely.
