Judge to block Florida abortion ban; Kentucky ban on hold

TALLAHASSEE, Fla. (AP) — A Florida judge said Thursday that he will temporarily block a 15-week ban on abortions in his state, but his bench ruling won’t take effect before the ban becomes law Friday — an issue that could cause confusion for patients as well as abortion providers.

Meanwhile, a Kentucky judge temporarily blocked that state’s near-total ban on abortions, allowing the procedures to resume after they were abruptly stopped when the U.S. Supreme Court overturned Roe v. Wade last week.

The cases in Florida and Kentucky reflect battles being waged in courts across the country after the Supreme Court said abortion was no longer protected under the federal constitution. The high court left it up to states to decide whether abortion is legal within their borders — forcing attorneys on both sides of the debate to turn to their state constitutions.

Judicial activism at the Federal level being replaced by judicial activism at the state level.

I’m getting so tired of these a-hole political judges and their dictates from the bench based on their politics and not the law. They are going to be as much at fault if we move into a hot revolution as the lying MSM.

This is not what SCOTUS meant when they said the courts were getting out of the middle of it and returning it to the states for the people to debate it.

Chief Justice Roberts needs to get his branch of government under control.

I think the argument is over whether the state constitution’s right to privacy includes the decision to have an abortion. I believe one judge has already said it did not.

Tossing the issue to the states means that the legislatures will have to craft law with great care. And the ones that have already passed trigger laws will now need to tell the courts that they have the right of way.

They meant for the state legislatures, who represent the people, to debate the issue and pass legislation. They didn't mean for the state courts to usurp the role of the legislatures. The courts need to back off and let the people have a chance to work it out first.

Democratic judges will be doing this all across the country. the democrats will stand in the way of the inevitable, allowing the states to take over like it says in the 10th Amendment until they are stopped.
