Thanks, that’s a clever suggestion. The problem is that a law allowing private parties to end a person’s life (murder) a child runs afoul of the equal protection clause. If a murder, or the taking another person’s life, is punished by the state in all cases except that of a newborn, then is not that class of newborns denied equal protection under the law? You might argue about when a fetus becomes a “person”, but once born it is unquestionably a “person”
