One of the things I talked about when this first hit was that OSHA, the EPA, FDA, etc. exist outside of the legal framework.
They pass regulations without a law. Enforce it, and do everything without much recourse to elected officials.

On the contrary. In US v SWANCC and US v Raponos, the USSC ruled that agencies can’t make up “laws” that go beyond clear congressional legislative intent.
How these USSC decisions apply to the current issue is beyond my pay grade.
