Rittenhouse Case: Status Conference Set for Dominick Black

On August 25, 2020, Kyle Rittenhouse defended himself from numerous attackers with an AR15 type (Smith & Wesson M&P 15) rifle. The rifle was not legally owned by Kyle.  He had legal possession of it. This was due to a quirk in the law. People under the age of 18 have always been able to buy rifles from private owners and possess them, but they are not allowed to buy them from licensed federal dealers.

Kyle Rittenhouse had given money to Dominick Black to purchase the rifle from a licensed federal dealer, with the understanding he would transfer ownership and possession to Kyle when Kyle attained 18 years of age. This is not illegal, as no “substantial transfer” to Kyle took place. Dominick Black retained legal and physical possession of the rifle. Temporary transfers are allowed by federal law.

During the attacks on Kyle Rittenhouse, Kyle killed two men and wounded another in justified self-defense.

On August 27, 2020, Assistant District Attorney (ADA) T. Claire Binger charged Kyle Rittenhouse with possession of a dangerous weapon by a person under the age of 18. The law cited is Wisconsin Statutes 948.60.  The definition of a “dangerous weapon” in the statute is very specific. The statute exempts rifles and shotguns from the definition, as long as they are not “short barrel rifles and shotguns”. The same statute makes it a felony to knowingly provide a “dangerous weapon” to a person under the age of 18, if the weapon is discharged by the person under the age of 18, and results in the death of a person.

Four months after ADA T. Claire Binger charged Kyle Rittenhouse with the weapons charge, he charged Kyle’s friend, Dominick Black, with two felonies for providing the rifle to Kyle

The charges against Dominick Black should be dismissed. A hearing with Judge Bruce Schroeder is scheduled for 22 January.

Assistant District Attorney (ADA) T. Claire Binger should be ridden out of town on a rail. I won’t give my real opinion on what else should happen before that climax.

I’d make the argument that Black’s giving the rifle to Rittenhouse likely resulted in saving Rittenhouse’s life.

Good to know that it’s going to that judge, though.

It could be argued that the typically idiotic handling of firearms by movie actors in movies and TV has caused a great many needless and tragic deaths. (Do you remember the movie "Colors" from 1988? It basically started the civil war that currently rages at our doorstep.)

Gone are the days when an actor had any actual life experience, like having been in the Military, for example.

Children are snatched away from their parents by the entertainment industry after being indoctrinated to worship celebrities and actors, who are more and more likely to be completely clueless about what constitutes real life for most of the consumers of their "product."

(Ok, let's face it: A lot of parents willingly GIVE their kids to the entertainment industry. We were just talking about that. J Epstein couldn't have flourished like he did without celebrity-intoxicated parents. And H Weinstein could never have become so influential if there weren't lots and lots of honeys willing to hold their noses and let him manhandle them so they could have a shot at fame and fortune - later accusing him of rape, of course, when it became safe to do so!)

Why is the author speaking of rifles - plural? There was just the one that Rittenhouse used, right? This author is an authority on the subject of gun related matters so I wonder what he meant by “rifles.”

Interesting.

By charging Dominick they likely will retain the rifle for "evedence" and Kyle will have a long time trying to get it back. And it will vanish from the evidence locker one dark night.

I read that several times, too. I think the writer is referring to the whole stash of such guns in the state’s possession in cases where the court determined “not guilty,” IOW, there was no crime committed.

There is the rifle Kyle Rittenhouse carried, and there is the rifle Dominick Black carried.

More than free.....so arrogant that he maintains that he didn't pull the trigger. I saw a demo the other day...the ONLY way it can fire is by pulling the trigger. He's a damn liar.

And we're no longer hearing about normal precautions...like shields if he's aiming at a specific point....like checking the gun...

I'm hearing that the armorer loaded 5 shells.

The media has been saying anything it wants....true, not true...doesn't matter. It's a story.
