Jacob Chansley, known to some as the "QAnon Shaman," has filed an appeal to his 41-month prison sentence following his involvement with the January 6 attack on the Capitol.

"We did file a 'Notice of Appeal' yesterday," attorney Bill Shipley told Insider. "We have made no decisions yet about what issues might be appealed, or even if an appeal will actually be pursued. But we wanted to preserve the option to do so while we discuss the matter further with Mr. Chansley, and better understand the case against him."

It's not impossible to appeal after you have pled guilty but it's awfully hard. And a reason for appeal is definitely helpful.

Looking at the disparity of the sentences of him and that
ANTIFA perp, it certainly gives me cause to think the two
were sentenced by two different standards.

I will say that this guy may have some charges that were
a higher level of infraction, but I don’t see that much
of a difference considering the lopsided penalties.

Any Congressional office should be considered just as
sanctified as the Capital Building. It is an official
office of a member of Congress. It is effectively a
satellite office of Capital Hill.

How about the prison sentence violating the 8th Amendment?

He should get Sessions to be his lawyer.
I hear you can always trust Sessions.

Which ANTIFA perp?

He had charges that could have sent him away for decades. He only pled guilty to one change and the 41 months was within the sentencing guidelines that the plea deal laid out.

What's cruel and unusual about it?

They wrote the headline. I agree it's hard to have an insurrection when nobody has been charged with insurrection.

41 month prison sentence for walking around inside the Capitol isn’t cruel and unusual punishment? As a kid I walked around inside the Capitol and never even got arrested.

I'm assuming you were there legally.

I thought if you accept a plea bargain you can’t appeal?

There was an ANTIFA perp who took an axe to a Republican Congressman’s office in his district.

He got off with a pretty light sentence. Now I’m not saying
this guy should have gotten off with the same level of
penalty. I’m just not convinced he should have been given
41 months and the other person getting off with probation
and a fine.

There are two factors here. The guy was affiliated with
a known terrorist group. He attacked a Congressional
office thought to be a Conservative rather than an avowed
Leftist.

Again, I do realize the 41 month sentence was given to
a guy charged with different infractions, so I’m not
against him getting more of a penalty.

Shouldn’t the other guy have at least had to do some time?
He was evidently armed rather heavily.

You can, but you have to prove that you had no knowledge or understanding of the details of the plea agreement and you're withdrawing your agreement. Chansley may not be the sharpest tool in the shed but he'd have a hard time proving that.

I assume that you can probably appeal if there was misconduct by the prosecution.

41 months for dressing like an idiot, trespassing, and yelling at the ceiling…

Ridiculous.

It was an excessive, cruel and unusual punishment for the “crime”.

If you can prove it, yes.
