A tax slapped on billionaires is unconstitutional. You cannot have a wealth tax. This has long been documented, but please don’t tell the Democrats. I want to keep this ongoing theater of broken dreams going. They have no mandate to do what they’re doing concerning government spending. None. They think they do, which is why things are such a mess. And the irony of it all is that Democrats are the ones mucking up the works for a Biden legislative win. It’s right there, folks. Right there. It’s the $1.2 trillion bipartisan infrastructure bill that has over a dozen GOP senators on board. It also has GOP support in the House, along with most of the moderate Democrats. It's still a terrible bill, but it's one that can easily pass. Joe knows he needs a win on this front. Well, it’s right there. It’s the progressives who want the $3.5 trillion reconciliation package passed first that are clogging the spot. They want this passed first and won’t even look at the $1.2 trillion package until then. The Democrats are stopping…the Democrats from passing a bill Joe desperately needs.

I would argue that progressive taxation is unconstitutional because, going back to Corfield v Coryell it is clearly stated that among out Privileges and Immunities — the other rights retained in the 9th Amendment — is to not tax different persons differently … and your income isn’t paying the tax … you are!

And while an argument may be made on account of the soak the super rich diatribe that was part of the arguments for the 16th Amendment, and which could be said to have established its intent, that still means that progressive income taxes for everyone who isn’t in that inflation adjusted group should be simply gone. And as for any form of progressive taxation beside the income tax, or and State taxation, Corfield should be seen as forbiding all efforts at progressive taxation which inherently tax some persons differently than others.

That’s actually not true. They can tax whatever they want. There are actually many wealth taxes - like the property tax and car registration tax. Some states has intangible taxes. Etc.

In some ways, the wealth tax is more socially desirable than the income tax as income fluctuates a lot, while wealth is more stable. It kind of reduces the urge of people to hoard resources.

The main problem with wealth taxes are that they are notoriously hard to enforce. It is easy to conceal wealth, hard to appraise all your possessions and extreme invasion of privacy if instituted.
But unconstitutional - NOT!

Hey, I hear you.

Personally I’d take those slave owners over the baby killers and poofter / TG adorers of the modern culture any day of the week. They weren’t much good but compared to this lot swimming in the deepest, foulest parts of a dank fetid cesspool and pretending they’re moral and better they often come off smelling like roses.

No, they cannot tax whatever they want.

There must be an enumerated power for the specific kind of tax in question and, moreover, an enumerated power for what the tax in being levied to fund if it is being levied for specific ends.

There is no enumerated power for federal estate or gift taxes and those are unconstitutional no matter what the government in abeyance may insist.
