And, since he used a gun and shot the teacher, that assault becomes aggravated.

First of all, the shooter's social media screams "down-low", and if you listen closely to the beatdown video, the attacker said a lot of weird shit, especially at the end. Looks like he got karma'd.
Putting myself in the DA's shoes (LOL), I would approach Pettitt with the incarceration options for Simpkins, and give weight to his input. For all we know Pettitt blessed the release.
