Biden proposes DACA workaround: a rule to shield ‘Dreamers’

The Biden administration on Monday renewed efforts to shield hundreds of thousands of immigrants who came to the United States as young children from deportation, proposing to do so via regulation, the latest maneuver in a long-running drama over the policy’s legality.

The proposed rule attempts to satisfy concerns of a federal judge in Houston who ruled in July that the Deferred Action for Childhood Arrivals program was illegal. It takes on heightened importance as prospects for legislation have dimmed.

U.S. District Judge Andrew Hanen, an appointee of President George W. Bush, said the Obama administration overstepped its authority and did not properly seek feedback when it introduced DACA in 2012.

The Biden administration announced the move as congressional Democrats struggle to include immigration provisions in their 10-year, $3.5 trillion package of social and environment initiatives.

The Obama administration created DACA via a memo issued by then-Homeland Security Secretary Janet Napolitano. It was intended as a stopgap measure until Congress legislated a permanent solution, which never occurred.

In attempting to shore up DACA through a formal rule — which is a more rigorous process than the original memo, though still not legislation — the Biden administration hopes to gain a legal stamp of approval from the courts.

All legislative Powers herein granted shall be vested in a Congress of the United States, which shall consist of a Senate and House of Representatives.

That's the first sentence after the preamble. There's no mention of "memo" or "regulatation." And, Liz Cheney contends that DJT "doesn't believe in the rule of law."

Presidents used to just act and announce. They didn’t run incomplete plans out to the country on a trial feedback basis.

Takes awhile to go through the Notice and Comment for a new rule properly. And the moment the new rule actually gets implemented, there will be new lawsuits. And all we have to do is win just one.

I think Trump even wanted to work a deal to let these folks stay but the Rats didn’t want any part of a deal including the wall. Can’t let Trump have a win has cost the USA a lot at times.

Why did the GOP not learn from the democrats during the Bush and Trump administration?

If Trump or Bush so much as said “it will be a sunny day today” the dems RAN to the courthouse to file injunctions and fought like hell to get the statement overturned.

Even Ted Cruz. for example, lets this kind of crap happen constantly.

How many years did the Republicans have a majority and a chance to fix this and did nothing. They want the cheap labor and the Dems want the votes. They work together to make sure no borders in the future.
