Court Declares Laws Banning Handgun Sales To People Under 21 Unconstitutional

A federal appeals court ruled Thursday that federal laws banning firearms dealers from selling handguns to customers under the age of 21 were unconstitutional.

The United States Court of Appeals for the Fourth Circuit said in the decision that there was no reason to treat the Second Amendment any differently from other constitutional rights citizens enjoy no later than the age of 18. The court ruled that 18-year-olds possess Second Amendment rights, and the federal government failed “to justify its infringement of those rights under the appropriate level of scrutiny.”

Yet another example of legislatures - federal and state - and courts - also federal and state - allowing plainly unconstitutional laws to be enacted because they believe (perhaps correctly) that it serves the public interest.

If raising the drinking age to 21 is a compelling argument, then they should have no problems amending the Constitution to enact prohibition just as they amended the Constitution to enact the Volstead Act. Instead, they prefer to have the Court invent the concept of different levels of ‘scrutiny’ based on age, something that isn’t found anywhere in the USC. This is how lazy Republics work and ultimately, it erodes everyone’s freedoms.

If 18 year olds are adults they should be able to drink and own any weapon they want.

The thing is, you can OWN a handgun at age 18, but you just can’t buy one from a licensed dealer.

It’s like making aerial fireworks illegal to use, but you can still buy them.

If anybody is old enough to vote and enlist to fight and die for our country, they should be able to own a gun and/or legally drink.
The liberals are pushing the voting age down to get the vote, but the rights of adulthood up, to have more control over them.
Come to think about it, another example of liberal condescension.

This makes sense.

States have the authority to set an age, that’s how their constitutions are set up. The Federal Government has no purview here. Shall not be infringed is absolute.

Yup. I was 18 when I entered the Army. I was just turning 19 when I shipped out to Vietnam. I could not buy a beer in any of the enlisted men’s club on Fort Jackson, S.C., nor could I purchase beer off base at a bar or store. Basically I did not drink anyway, but couldn’t buy it if I wanted to. Funny thing was, when I got to Nam and everyone went to the club out on our base, I was allowed to buy beer there, hell we were in combat zones!! I could go to war, shoot and kill people, but I could not buy a beer if I had wanted to.

THAT HAPPENED in Washington state when I lived up there. The Indian Reservations could sell fireworks but you could not buy them off the Rez. I think it was in the city of Auburn, or near there (down below Seattle), where the Auburn cops would sit around in plain cars, watch people purchase fireworks, and then follow them off the Rez and have marked cars stop those cars and tell them they had been seen with illegal fireworks!!! They would then take the fireworks away from them, ticket them with a court date for illegal fireworks possession. I think I have the city right, but it was down in that area that they were doing that.

Good!! When my Mom’s uncle was 18 we was being shot at by nazis. Fortunately thanks to his govt issued rifle and training he received courtesy of the US Army he took out a couple of them and was eventually HONORABLY DISCHARGED.
