US appeals court [9th Circus] blocks judge’s decision to overturn state’s assault weapons ban

The 9th Circuit, acting on a June 10 appeal filed by Atty. Gen. Rob Bonta, put Benitez’s ruling on hold pending a full-blown decision.

“This leaves our assault weapons laws in effect while appellate proceedings continue,” Bonta said said in a tweet. “We won’t stop defending these life-saving laws.”

The 9th Circuit judges on the panel issuing the stay were Barry G. Silverman, a Clinton appointee, Jacqueline Nguyen, an Obama appointee and Ryan D. Nelson, a Trump appointee.

Benitez, appointed by former President George W. Bush, said the weapons ban unconstitutionally infringed on the rights of California gun owners and “has had no effect” on curtailing mass shootings.

California is one of seven states and Washington DC that ban assault weapons. The California case is expected eventually to go up to the Supreme Court, where a majority of justices are conservative and some have been highly critical of gun regulations.

Twenty-two states, led by Arizona, which is under the 9th Circuit’s jurisdiction, asked the appeals court to uphold the order against California’s law.

Joining Arizona were the state of Alabama, Alaska, Arkansas, Georgia, Idaho, Indiana, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, Ohio, Oklahoma, South Carolina, Tennessee, Texas, Utah, West Virginia, and Wyoming.

Do we need a Go Fund Me page to pay off the chief justice?

Historically, the full panel of the 9th circuit has been favorable to the 2nd Amendment.

But it takes 4 years to get there.

Who cares about the courts?

The Supreme Court today issued a decision about the NCAA vs. Student athletes.

But they COULDN’T issue a ruling in the Texas case vs another state.

Who cares.

The decision in question was very comprehensive. Full circuit is gonna have a hard time knocking down EVERY point, any of which is enough to repeal the AW ban.

One consequence of our letting the DemoNaziCommies steal the election is that we won’t be getting any new judges that will honor and obey the US Constitution. Prepare for more and more of our rights to be taken away from us the next few years.

"His decision overturning the assault weapons ban spurred outrage across the country."

Totally neutral reporting right there. Nice job ya dumb twat.

Absolutely expected. They’ll hear it as a panel, then en banc to further slow down any adverse result.

Those rights are God given, they may violate them, but they can never take them.

Attorney General Rob Bonta destroyed his own appeal when he included in the tweet, "We won’t stop defending these life-saving laws."

His statement is indefensible in court. The data collected over more than a decade clearly shows that ownership of firearms by law abiding citizens saves lives.
