Gov. Parson will sign Second Amendment bill declaring federal gun laws ‘invalid’ in Missouri

JEFFERSON CITY, Mo. - Missouri police will be barred from enforcing federal gun laws that regulate weapons registration, tracking and possession of firearms by some domestic violence offenders under a bill Gov. Mike Parson, a former sheriff, announced Thursday he will sign into law.

Passage of the “Second Amendment Preservation Act” represents a victory for conservatives who have pushed the legislation for nearly a decade and picked up new momentum this year by responding to the Biden administration’s vows to enact stricter gun control.

It’s been met by outrage and alarm from Democrats and gun control advocates, who have slammed the measure as dangerous in a state with such high rates of gun violence. Missouri had the nation’s third-highest per-capita rate of gun deaths in 2020.

In particular, gun control advocates have focused on what they call the “domestic violence loophole” that the legislation would solidify. Federal law prohibits gun possession for those convicted of domestic violence misdemeanors, but when Missouri passed a permitless concealed carry law in 2016, sheriffs were no longer conducting background checks.

Under the Second Amendment Preservation Act, that federal limitation is one of many gun laws that would be declared “invalid” in the state. Missouri law only prohibits felons and fugitives from having guns.

Critics have questioned the legality of “nullifying” federal laws, pointing to the Constitution’s Supremacy Clause. But proponents of the bill have brushed it off.

“We’re just simply saying we’re not going to lift a finger to enforce their rules,” state Sen. Eric Burlison, a Battlefield Republican, said last month.

No enumerated power for federal gun laws ... the 10th Amendment is the controlling power so nullification is entirely proper.

Well lets see. The only thing about guns in the federal constitution is that thing about the right to bear arms shall not be infringed. And yet the federal constitution leaves things that are not in the federal constitution up to the states. Lets hope that people wake up.

Article makes it sound like it’s all about domestic violence. It’s not. It’s mostly about future gun grabs by the feds.

No Missouri does not have a high rate of gun violence. It may have a high rate of human violence with people who use guns. What kind of people might that be?

What they don’t say is that the overwhelming majority of gun violence in Missouri is actually in the city of St. Louis and it’s committed by POC’s with illegal guns. It’s the violence that BLM doesn’t care about.

Missouri isn’t nullifying Federal law, it’s nullifying unconstitutional laws, which happen to be federal.

They think that since back in the day when towns like Dodge City KS had no carry laws in effect, that those ordinances can be applied nation wide.

Hm. So those critics can apparently read the Constitution if they know about the Supremacy Clause, but have they not read the 2nd or 10th Amendments?

Right? Its the exact same thing Sanctuary cities do, they just dont enforce federal laws or help the feds out in any way. Same as in liberal states and cities where they say the police wont be enforcing shoplifting laws or other non-violent crimes

Having been a LEO there... Maybe there is room for “hope”. But, any “optimism” is guarded by my experiences and I still harbor doubts. missouri was like a political minefield that I survived. I survived, but I was targeted and suffered from the “climbers” I find it impossible to believe that ANY of that has changed. Human nature is human nature. I know all about the ugly side of that. It was getting bad back then. But I feel sorry for the poor fellas today. I know that it is so much worse for them.
