ST. JOHN THE BAPTIST PARISH, La. — A St. John the Baptist pastor whose 2014 murder conviction was thrown out by the U.S. Supreme Court last year is now running for Congress from his jail cell in central Louisiana while he waits for a new trial.
Errol Victor Sr., 54, qualified Thursday to run as a Republican in the 5th Congressional District for the seat left vacant when Congressman-elect Luke Letlow died of complications from COVID-19 before he could take office.
Victor is one of seven candidates vying for the seat in a special election in March. Letlow’s widow, Julia Letlow, is widely considered a frontrunner for the seat.

During emergency treatment, after M.L.’s clothes were removed, it was discovered that his backside from his neck to his knees was covered in deep bruises. Other injuries were discovered as well: M.L.’s buttocks were both scraped, he had wounds on his forearm, and an injury to his neck.”

Why did his conviction get thrown out?
It was a non-unanimous jury decision.
The Supreme Court decision was posted - but they don’t state it directly.
You would have to know what the ‘Ramos’ decision was.
Louisiana finally rejoined the normal world on this issue. If the State want to send you to jail, they have to get a unanimous jury decision.
After Reconstruction, Louisiana went with a reduced verdict (originally 9-3 then later 10-2). There was a bad Supreme Court decision about 50 years prior 4-4-1 The 1 setting the crazy policy to continue.
In Ramos, Gorsuch wrote the decision overturning this long standing bad policy. I believe Kavanaugh and Thomas both wrote decisions concurring.
Louisiana had changed their Constitution just the year before, but made the change only affect future cases. The courts are reviewing the prior cases and overturning where appropriate.
Victor remains in jail and awaits a retrial.

Thank you for explaining, I could never read through those docs and understand this, and as you say I’d’ve needed to google Ramos!
So, this man is almost certainly guilty as charged and will be tried again for his crime(s). Does seem like that could have happened already, but I suppose he’s been in jail the whole time anyway.
I won’t get into his running for office. I’ll just say RIP for the poor child who was murdered.
