Parler loses bid to require Amazon to restore service

A U.S. federal judge on Thursday rejected Parler’s demand that Amazon.com Inc restore web hosting services for the social media platform, which Amazon had cut off following the Jan. 6 storming of the U.S. Capitol.

U.S. District Judge Barbara Rothstein in Seattle said Parler was unlikely to prove Amazon breached its contract or violated antitrust law by suspending service on Jan. 10, and that it was “not a close call.”

She also forcefully rejected the suggestion that the public interest would be served by a preliminary injunction requiring Amazon Web Services to “host the kind of abusive, violent content at issue in this case, particularly in light of the recent riots at the U.S. Capitol.”

“That event,” she added, “was a tragic reminder that inflammatory rhetoric can - more swiftly and easily than many of us would have hoped - turn a lawful protest into a violent insurrection.”

If the judge would have looked outside her window today she would have seen ANTIFA rioting.

That's the same ANTIFA that Amazon allows to sell t-shirts on its website.

That's the same Amazon that won't allow Parler on its web hosting.

Thanks for your wisdom, jimjohn. I suppose the closest thing to a similar business model pre-Internet would be with most media. Radio shows buying time on radio stations, same with TV shows.

Amazon is a competitor. They should not have any voice whether or not Parler becomes fully operational.

The problem is that Parler chose to host its servers on Amazon Web Services. The other problem is that there are not many good alternatives to Amazon Web Services, unless you're willing and able to build out your own scalable server farm.

I’ll give you a better one.

Dump cloud providers.

I understand the advantage of it. I use them professionally, but this has made it clear they just can’t be trusted.

Everyone needs to learn Linux so organizations get moved back to on prem hosting without the MS licensing fees for Windows Server.

Sounds like the judge had “pre-judged” the case. How does she KNOW that Parler content was anything like she described?

Learn Kubernetes so you can easily spin up new instances to deal with increased traffic.

It’s actually getting much easier to manage your own servers.

If your an employer you should be able to figure out if they are a RAT by asking them a few simple questions or making some small comments. If they are a RAT, no job!

Looks like a neat product.

As much as I detest Linux for lacking any set standard, it does have the advantage of getting you out of Microsoft’s very costly on prem licensing schemes.

Everyone needs to learn new tools that are not controlled by big tech.

But it’s fine to force a bakery to make a devil wedding cake for devil worshipers or a gay wedding cake for gay couples.

Amazon clearly breached their contract with Parler. And everyone else in the industry denied them continuing service on the basis of a lie about Parler’s content.

Amazon sells all manner of deadly weapons on their web site, for profit. It just reeks.

Say goodbye to Free Republic. When judges can arbitrarily decide what is yelling fire in a crowded theater and who yelled it...it is over for anyone with which they simply disagree.

No, they are trying to compel them to honor a previous contract. They are not competitors. Do you know anything about what happen? Indeed Parler was stupid for putting themselves in that position but Amazon do not honor their terms of service, plain and simple.
