Proclamation on the Termination Of Emergency With Respect To The Southern Border Of The United States And Redirection Of Funds Diverted To Border Wall Construction

I (Biden) have determined that the declaration of a national emergency at our southern border in Proclamation 9844 of February 15, 2019 (Declaring a National Emergency Concerning the Southern Border of the United States), was unwarranted. It shall be the policy of my Administration that no more American taxpayer dollars be diverted to construct a border wall. I am also directing a careful review of all resources appropriated or redirected to construct a southern border wall...

...pause work on each construction project on the southern border wall, to the extent permitted by law, as soon as possible but in no case later than seven days from the date of this proclamation...

...The Secretary of Defense and the Secretary of Homeland Security may make an exception to the pause, however, for urgent measures needed to avert immediate physical dangers or where an exception is required to ensure that funds appropriated by the Congress fulfill their intended purpose...

...develop a plan for the redirection of funds concerning the southern border wall, as appropriate and consistent with applicable law. The process of developing the plan shall include consideration of terminating or repurposing contracts with private contractors engaged in wall construction, while providing for the expenditure of any funds that the Congress expressly appropriated for wall construction, consistent with their appropriated purpose. The plan shall be developed within 60 days from the date of this proclamation.

Leaves the door open to continuing the Congressionally appropriated miles in the Rio Grande Valley and Laredo Sectors of South Texas.

But it does halt all Border Wall work within a week, until they come up with their plan. They say 60 days, but I'd expect delays.

Immediate halt to all border wall projects (but SecDef or Sec DHS can waive) within the next seven days, until they have a new plan (which they aspire to have within 60 days).

The money diverted by the emergency declaration seems certain to be pulled back, but the 2019, 2020 and 2021 Congressional appropriations for the Rio Grande Valley and Laredo Sectors seems to still have a good shot at executing for levees, roads, lights, cameras, alarms - maybe even bollards.

The President has the authority to halt work or terminate contracts for the convenience of the Government. The Government is responsible to compensate Contractors for all reasonable costs incurred.

The US Army Corps of Engineers, who are the Contracting Activity for all of the Border Wall Projects, has confirmed that all of the contracts include the standard clause, allowing for termination for the convenience of the Government.

Instead of “Open Sesame”, the magic word will be “Asylum”.

It will probably take six months to get people appointed, change policy, and fund all the logistics - as well as for COVID to blow over. After that, it is “Katie bar the Door!” The bum’s rush to pack swing States and Districts will be on in earnest.

Sounds like the contracts remain on hold, until the Administration decides what to do.

So do all the workers remain on the payroll during that time, expending funds for no value?

We knew this SOB Biden would pull this crap. At least President Trump pardoned Bannon. Not sure why he didn't the rest. Kolfrage,etc. from We Build the Wall. Well, it was good while it lasted. Had big effect on info of illegals in several areas. About 470 miles...
