This argument is authoritarian in its reasoning. It defers to a juridical priesthood and allows one guild, the attorneys, to override what average people can see in front of them. Such an argument should not stagger wise conservatives. The latter can always draw from Plato's Republic and the debate between Socrates and Thrasymachus over whether justice is merely defined as whatever the mightiest people in society say it is.
Spoiler! Socrates wins that debate. That's partly why people live in free republics in many parts of the world 2,400 years later.
Juridical systems have a long and checkered history. In researching a current book project, Traumatizing the Tongue, I spent years researching the Spanish Inquisition, the French Reign of Terror, the German Gestapo, and the Soviet gulags. In each of these historical examples, political and social upheaval led to illogical judicial systems whose irrational decrees distorted language itself, past the point where Spanish, French, or German could fully recover.
People who have been granted juridical authority can indeed err en masse by an enormous margin, for long periods of time, on matters that should be obvious. No human language has ever appeared that can withstand the basic warning of Jeremiah 17:9 (inside the heart is wickedness beyond measure).

Understood. I am fully aware of the high bar for Treason and why it is there.
But did Bergdahl commit treason? At the very least desertion in war, but he went to the other side, so...not desertion, treason.

To some on the left posting on Free Republic, or voting for Donald Trump, are acts of treason.
I have never been in that camp of simple “you voted for candidate x, that is treason” which is what the Left does. But to be fair, voting for a candidate who is clearly and unequivocally bought and paid for by a hostile foreign power, and knowingly doing so...is THAT treason?
Many stupid leftist voters may look at money sent to Hunter Biden to be given to “The Big Guy” may be and are stupid enough to buy the media’s pat stand that “The Big Guy” wasn’t Joe Biden, even contrary to Biden’s business partner who would know better and said otherwise.

If someone is conspiring with foreign countries to overthrow our Republic by buying off politicians and blackmailing to the same end, is that treason?
If people who work in government get on a zoom call, and discuss how to riot, take over government buildings, and organizing to do so...is THAT sedition? Because THAT sure as hell happened, and was known. I think it ABSOLUTELY is sedition.
My point is that there is no rule of law anymore, except when someone wants it to be.
And that isn’t rule of law as is done in a constitutional republic. That is rule by people, as is done in an oligarchy.
