Judge denies Tavern League's request to block Gov. Evers' (D, WI) indoor capacity order

BARRON COUNTY, Wis. -- A Barron County judge has ruled that a temporary restraining order against Gov. Tony Evers' order restricting indoor capacity in Wisconsin bars and restaurants be lifted, meaning that it is once again in effect.

Earlier this month, Gov. Evers ordered new restrictions limiting indoor capacity to 25 percent at all bars, restaurants, and stores statewide. Many business owners complained their businesses won't survive.

The Tavern League of Wisconsin sued, and last week Sawyer County Judge Don Yackel temporarily blocked the order with a restraining order. Monday, Judge James Babler removed the restraining order, arguing the plaintiffs had not proven any actual harm to businesses, just theoretical harm.

"Numerous businesses have gone under during the pandemic. We don't need to lose more in the name of acting quickly and ignoring the law," said Josh Johanningmeier, an attorney representing the Tavern League.

In response to the ruling, Gov. Evers released the following statement;

“This critically important ruling will help us prevent the spread of this virus by restoring limits on public gatherings. This crisis is urgent. Wisconsinites, stay home. Limit travel and going to gatherings, and please wear a face covering whenever you have to go out."

The case is another example of the governor's pandemic-related emergency orders being legally challenged.

The first pandemic-related statewide emergency order was blocked by the Wisconsin Supreme Court back in the spring when Republicans argued that Evers overreached in his authority.

WTF? Name a Blue State that ISN'T losing businesses by the truckload these days! Have you SEEN our Capitol Square and State Street? Long-time institutions/shops/bars/restaurants are now GONE, never to return!

FWIW, our 'Tavern League' is one of the strongest 'Unions' in our state. I really thought they'd get this done for us. :(

We're just so screwed economically, it's ridiculous.

Mandatory mask-wearing through November 22nd...and probably extended after that, too. @#$%^&*!

Oh, and by the way...just be a 'Good Little Citizen' and stay home, would ya? *SPIT*

This judge has obviously never worked a day in their life and obviously is entrenched deep into socialist academia where everything was handed to them.

Businesses at ALL levels should have already refused further sales to any government address or government employee at home (including this judge). Food delivery companies should refuse to continue to deliver to the State as it is too dangerous for their employee’s health. The sooner it hurts government employees or the constituents, the sooner ally voices will compel a stand-down.

“red team” win? Hate the Orwellian party color changes they got away with, blue was Washington’s Virginia military uniform color, well, the Left always lies.

Courts taking their sweet time to rule against these unconstitutional orders are making a mockery of the law.

What good does it do you if you have to wait for your business to go bankrupt, and lose everything you have to finally get a ruling that should have happened in less than a month.
