Why millions of freelancers fear a Biden presidency may put them out of work

Some are wondering what Democratic candidate Vice President Joe Biden’s public support for AB-5, a union-backed California law, aimed at preventing the misclassification of rideshare drivers by giving them the status and protections of full-time employees, means for the future of their businesses. AB-5 had to be modified repeatedly after taking effect on Jan. 1, 2020, because it was putting so many other types of freelancers out of work. “They are really worried about it,” says Bothwell. That’s because Biden -- historically a supporter of unions -- wants a federal law similar to AB-5 that could place steep restrictions on who can be a freelancer.

With more Americans freelancing than ever before, the future of freelance work is a key concern for some workers as the presidential election approaches. A recent Upwork survey, Freelance Forward 2020, found that 59 million Americans did some form of freelancing in 2019, up 2 million from the year before.

Many freelancers across the nation have been keeping an eye on headlines about AB-5. The law that took effect on Jan. 1, 2020 is an attempt to address inequities in the gig economy including the independent contractor policies of ride-sharing companies such as Lyft and Uber. It assumes that every worker in the state is an employee unless employers can prove otherwise using the rigorous “ABC test” it is based on.

There is a Ballot initiative to exempt Uber and Lyft from AB5. The problem I have is Uber and Lyft are ran by and staffed with 90% Plus Proud Democrats. Why should the rest of us help Bail them out of their Very Own Policies?? I am Voting NO, Suck it up Dems, these are your laws put in place by your people

I can see the pro/con of both sides of this as I work in both sides from time to time.

There are some needed changes to gig type platforms. Many of these folks are making a full-time living and living very well off these platforms. Others are living a true nightmare and a behind the scenes peek at one gig service might have you questioning the safety of the worker/freelance and the responsibility of fair disclosure.

I am a freelancer and I warned my compatriots about this over and over and over.

In my profession we sometimes work part time or full time under contract as 1099s for various companies to keep steady income streams. It can be kind of quasi-permanent or long term, i.e. 3-5 years.

They would weep, wail, and gnash their teeth about putting in well over 40 hours, no benefits, blah, blah, blah.

I TOLD them that the worst outcome will be that they will get what they want.

Predictably, California led the way.

Now they weep, wail, and gnash their teeth because postings for gig work always include verbiage indicating that the company will NOT contract with any freelancers in California.

A few more states have been added to the do-not-fly list. I believe they are MA and NJ, but, I could be wrong. Often am.

These people used to irritate the snot out of me with their constant whining about how *unfair* it was not to be given W2 employee status. There is no reasoning with entitled brats.

This was all pre-WuFlu. Now all of the work gets snapped up by red staters.

I’m a freelancer. A number of gig sites kicked off anyone from California to eliminate the hassles for their customers hiring people to write an article or create a book cover.

I’ve also seen a definite shift in who gets writing gigs. We’re back to:
* write for exposure, hoping it leads to paid work
* a knowledge professional writes it to publicize their services, like a lawyer answering questions in articles
* hiring Indians and Africans to keep costs down
