A lawsuit filed Monday in US District Court in Denver alleges the Colorado Secretary of State's office failed to clean up its voter rolls in compliance with the National Voter Registration Act.
The conservative, non-partisan educational foundation Judicial Watch filed the lawsuit along with three voters from El Paso, Elbert and Adams counties.
During the summer of 2019, the group commissioned a study where they compared voter registration data collected by the U.S. Election Assistance Commission (EAC) with the most recent five-year Census Bureau estimates of the voting-age population. Their study found that 40 of Colorado's 64 counties reported registration rates that exceeded 100% of the eligible citizen voting-age population.
Last month, the group again compared the Census data with voter registration numbers provided by the Colorado Secretary of State's Office. That second comparison revealed some 20 counties had voter registration rates that exceeded 100% of the eligible population. However, as many as 39 counties had registration rates that exceeded 100% during a single month of that 5-year period.
The lawsuit also contends that the counties removed comparatively low numbers of voters from the rolls even though the Census Bureau suggests a greater number of people had changed addresses. Additionally, the plaintiffs state that county clerks failed to send adequate numbers of address verification forms to voters as is required by the National Voter Registration Act.
It is a direct threat to free and fair elections that with record numbers of mail-in ballots this cycle, over half of Colorado counties have more people registered to vote than are eligible to register," said Judicial Watch President Tom Fitton in a news release. "With its inaction, Colorado has failed its citizens and opened itself up to potentially be the victim of massive voter fraud."

Effectively nothing.
Ballots have already been prepared for mailing based upon the existing voter rolls and will be mailed out tomorrow.
A large percentage of those ballots will be undeliverables. An ordinary commercial mailing list "rots" at 6%-10% per year due to moves, name changes, and deaths. Once can expect a similar rate for the voter rolls. Perhaps 15% of the total mailing will turn out to be undeliverable, and thus illegal to use.
It is not clear how many illegal ballots will be harvested by individuals and even less clear whether there are organized ballot harvesting operations active.
Boulder County has a signature verification procedure and they do reject some ballots which do not match in the opinion of the examiners. I have friends whose legal ballots were rejected for this reason. Oops.
Examiners check a signature (if they do) before a ballot is opened. In theory they cannot see the actual votes when they make a determination.
It is possible to appeal a rejection - effectively this means voting in person at the County Clerk's office.
I do not know what they are doing in Denver County.
Colorado has a well-established ballot tracking system which can tell voters if their ballots have been received and accepted for counting. I plan to check it after my ballot has been placed in a county drop box. I will not be using USPS to return my ballot.
If things go sideways with the signature verification, I will traipse on down to the County Clerk office and cast a ballot in person.
My in-laws came for a short visit, a couple of years ago. I just received their application forms for mail-in ballots - from Florida. If I do receive any of those ballots, I will be shredding them.
It’s time for some serious audits of elections.
Judicial Watch has been doing this in state after state, and are seemingly the only organization with the intent to do so. While good for them for doing so, how come nobody else is stepping up to the plate?
Ask Washington state. they routinely have 110% voter turnout in largely Democratically controlled counties. Usually just enough to win the election, with some held in reserve just in case they are needed.
Judges, if you can call them that, have always found for the Democrats.
One thing you can bet on- damned few of them will be Republicans.
