LANSING, MI -- Michigan Attorney General Dana Nessel will no longer enforce the governor’s executive orders by criminal prosecution, though she urges residents to continue following COVID-19 safety guidelines.
The announcement from Nessel’s office comes after the Michigan Supreme Court decision on Friday, Oct. 2, ruled the governor does not have authority to extend emergency orders under two emergency acts -- the Emergency Management Act from 1976 and the Emergency Powers of the Governor Act from 1945.
Neither act, the court ruled, gave Gov. Gretchen Whitmer the authority to continue declaring states of emergency or issuing unilateral orders under them past April 30, when her initial declaration would have expired.
The attorney general’s statement was released Sunday, Oct. 4, by press secretary Ryan Jarvi. The decision by Nessel’s office, Jarvi wrote, “is not binding on other law enforcement agencies or state departments with independent enforcement authority.”
The statement notes it is the attorney general’s “fervent hope” that people would continue to abide by measures put in place by the governor, including the use of face masks, social distancing guidelines and staying home when sick.
“If it weren’t for the governor’s actions, countless more of our friends, family and neighbors would have been lost to COVID-19,” the statement said. “We can respect both the court’s decision and the advice of medical experts by continuing with these important measures voluntarily.”
Whitmer previously said the emergency orders would remain in place for 21 days from the court’s decision, and that many of her responsive measures would continue under alternative sources of authority.

I am certain that there are many county DA’s who will refuse to prosecute local health department violations.
Same thing has happened in Pennsylvania. The main reason the Carlisle car shows and Williams Grove Speedway operate as normal—real normal, mask only if it makes you “feel safe”—is that the Cumberland County DA has repeatedly state that he will NOT prosecute any charges brought for violating the Governor’s “orders”.

I have been thinking about people who are too scared to take the mask off, even in their cars, and of course innocent children forced to wear a mask hour after hour, day after day. I worry those masks are not taken and washed often enough. Those people are wearing a Petri dish on their faces, and I suspect acne is becoming a real problem. What I really worry about though is that they could develop something really serious such as necrotizing fasciitis.
I NEVER wear a mask if I go to a store I put it on right before I walk in the door (required in CA.) the damn thing comes off immediately when one foot is out the door!! Being outside with a mask on is ridiculous!!!
