Golly Gee don't we remember that Matt Dillon always gave the guns back to those he let out of jail.

On a more sober note I have always contended that if a person is too dangerous to own a gun, they belong in jail, not on the street.

But they have a majority in the House. And 47 in the Senate.

I agree wholeheartedly. Of all of the Amendments, the 2nd is the one that those who believe in government as the solution to all problems hate the most, because it is a direct challenge to their authority...and that is exactly the point of the 2nd. It was put there first and foremost to ensure that if some then-future generation needed to take up arms to depose or replace a tyrannical government, as the Founding Generation did, then they would have the means by which to prosecute such a change.

Those who read the 2nd as being primarily to protect our right to defend ourselves against criminals, or to kill Bambi, are wholly missing the point. Those things, as important as they may be, are just a little bit of dessert compared to the main course of protecting our means of self defense against a rogue government (or an invasion by a different government intent upon eliminating our liberties).

Judges are under enormous pressure to cave on this issue, and the fact that “Notorious ACB” has resisted that pressure, and that she is true to her oath of preserving and protecting the Constitution, speak incredibly highly of her. Maybe once she’s confirmed, some 2A cases will actually find their way toward getting Cert - because before now and for several years, it has been a total crap shoot because Roberts has been completely squishy (and I believe that is because he has been blackmailed). Now the Justices can decide to hear these cases because we’ll be a solid 5-4 winner, and possibly 6-3 once Roberts’ blackmailers understand that his vote is now meaningless.

The “logic” (if you can call it that) of this state of affairs is that just because you make it illegal for a convicted felon to buy or possess a firearm, therefore he will obey that law - as will anyone who has an unmarked or stolen firearm that they’re looking to fence, no questions asked.

IOW, we have been for over 100 years, and are continuing to deal with, a bunch of stupid bastards in the government...hardly a surprising phenomenon for anyone with functioning eyes, ears and just a handful of properly operating neurons.

She is suppose to protect and defend our Constitution... nothing more and most certainly nothing less. Could anyone please point out where in the Constitution that makes ‘precedence’ the law of the land? Christ warned US about those that sit in the seat of Moses.

Lower courts are bound by the precedents of the courts above them. SCOTUS might use precedent to write and explain their opinion if they agree with said precedent. But they are most certainly not bound by it. The constitution is superior to ANY precedent. Dead SCOTUS Justices are not superior to the living. In fact, the opposite is true.

A female Scalia. It does not get better than this. Young with many years left on the court, smart legally in the extreme, a strict constitutionaalist. Scalia is looking down and smiling. I love it.

Completely agree. If someone is too dangerous to own a firearm legally, they are too dangerous to be walking the streets. When we allow our rights to be selectively muted based on crimes, all things will be made crimes to ensure our rights can be legally eliminated.

If they can’t take away our guns without cause under the US Constitution and they can’t put us all in prison for practical reasons, then the only option remaining is to make as many of us as possible “prohibited persons”. That’s the route Maryland and others have taken: drum up excuses for why somebody can’t ever touch a gun again and let Federal law help enforce that. “Oh, you got in a bar fight in 1975 and entered a guilty plea so your night and jail and $50 fine were the only punishment? Well... CLEARLY you can’t EVER own or handle a firearm for the rest of your life!” Seriously, they went back and changed the law to add retroactive punishment removing constitutional rights for crimes committed decades previous.

If you don’t think felons should have guns, or you don’t think violent criminals who’ve served their sentences should have guns, keep them in prison. If they’re out of prison, they’re citizens, and they have rights. If they don’t, then your own rights are just one ridiculous law away from disappearing.
