A federal appeals court on Thursday upheld a decision to throw out felony conspiracy and weapons charges against Bunkerville rancher Cliven Bundy, two of his sons and another man.
Before U.S. District Judge Gloria Navarro’s January 2018 dismissal, which the government appealed, she found that the federal government improperly withheld evidence. Prosecutors had willfully withheld video surveillance, maps and FBI interview information in violation of due process required by the U.S. Constitution, the judge found.
A three-judge panel of the 9th U.S. Circuit Court of Appeals agreed.
“We can find no grounds for concluding that the district court abused its discretion in dismissing this indictment with prejudice,” Judge Jay Bybee wrote in the 54-page decision, pointing out that Navarro conducted several hearings about evidence violations. “Lesser sanctions — such as a continuance to allow the defendants to review discovery or declaring a mistrial and starting over—would have given the government an opportunity to strengthen its case at the defendants’ expense.”
Nevada U.S. Attorney Nicholas Trutanich focused on a footnote in the decision that directly addressed prosecutors.

So when will charges be filed against feds who did these things? A man is dead and someone should be held accountable!
They tried to fix the case and got burned. Then it’s the usual weasel words so the Feds can do it again and hopefully not get caught.
The drawn-out process is intended as part of the punishment.
There are essentially limitless resources on the gubmint side.

Prayerfully, justice will ultimately and swiftly be served by a judge not holden to the wickedness of the socialist left. Prayers up that this will take place, and then a domino effect uprooting every despicable person and act within the F.B.I. and associated entities.

Cliven Bundy has an uncanny resemblance to Michael Flynn.
Compare how the Bundys, LaVar Finicum and associates were treated for truly “peacefully” protesting actual state and federal injustice with how violent blm/antifa seditionist are treated.
And why is there no punishment when prosecutors are found to have purposely withheld critical evidence. The judge should have ordered the head of FBI to jail for 60 days just for starters.

Why couldn’t have used the BLM goon squad against the domestic terrorists in Portland to protect the federal court house? Isn’t that what the BLM protects “federal property”? Bureau Land Management, not Black Lives Matter, but it would be poetic justice to use the Bureau BLM against the BLM Black Lives Matter goons.
Good thing judge Sullivan wasn’t the trial judge.
