FEMA’s Disaster Unemployment Assistance (DUA) program is available to state, tribal, and territorial governments to provide unemployment benefits and reemployment services to individuals who have become unemployed as a direct result of an incident that resulted in a Presidential major disaster declaration for Individual Assistance and who are not eligible for regular state unemployment insurance.

From Polutical’s ‘s (otherwise horribly biased report)...

“The president signed a memorandum directing the use of funds from FEMA’s Disaster Relief Fund, or DRF, which has an unobligated balance of $79 billion, to provide for an additional $400 per week in unemployment benefits. The disaster aid that could be used would be capped at $44 billion. “

Gee, I’m surprised there’s an “unobligated balance” anywhere in DC!

Capped - even better. Start giving out checks and tell the RATs they need to commit more money, or benefits will end - I’m sure it’s possible to move treasury funds around as well.

The PUA program, now paying benefits to the self employed, is using FEMA statutes as it’s legal foundation. Fema statutes require a person to be ineligible for any other benefits in order to qualify for Disaster Unemployment (or PUA). I’d be curious how an executive order can legally get around that.

The other concern I have is that it sets a precedent for the next liberal president to go wild with executive orders.

That’s very squishy language - and who knows, maybe some other directive allows that part to be modified. This only has to last about 10 weeks and then there’s an election.

and remember, Justice Roberts just said, once a program is started via EO (DACA), even if it’s illegal, it has to go thru a legal process (lasting months) before it can be ended.

We already crossed the Rubicon - in a normal world, Congress would agree to fund a disaster, but toxic politics is preventing that.
