‘Flatly Violates Due Process’ – Louisiana Attorney General Says Democrat Governor’s Mask Mandate ‘Likely Unconstitutional’

Louisiana Attorney General Jeff Landry (R) said Wednesday in a 9-page legal opinion that the Democrat governor’s mask mandate is “likely unconstitutional and unenforceable.”

Democrat Governor John Bel Edwards over the weekend announced a statewide mask mandate and additional restrictions

Landry also said that the Governor has no power to make substantive law through an executive order, even in an emergency and asserts that the mask mandate “exposes individuals to unlawful searches and seizures, as well as burdens them with exposing potentially sensitive personal health information and having it exposed to others in a public setting.”

its ture for every governor tyrant who’s issued these ‘orders’

none of them have legislative power to just create law by themselves out of thin air

you would think more people on this site would know this and denounce wvery govtard who does this

but too many here are totally down with it because it makes them feel good

These on gong executive orders from many states negate the legislature and eliminate a representative form of government. That make them all unconstitutional based on that alone.

Governor Creosote here in Illinois got a smack down declaring all of his orders illegal and unenforceable 3 weeks ago. He promised to appeal but hasn’t bothered to file one yet.

Not one word about it in the local press.

How are they going to enforce this? There have already been violent confrontations over this. A bus driver in the UK was beaten to death over this crap. Are the people who are destroying law enforcement and refusing to stop the rioting and monument wreckers really going to throw people without masks into the gulag? We are headed toward utter chaos.

Democrat governors across the US have issued similar unconstitutional statewide mask mandates.

All of the Commie governors used the Coronavirus to stage coups and concentrate all government power in themselves. One way or another, a "Republican Form of Government" (as required by Article IV, Section 4 of the Constitution) must be restored in those States.

Governor Bullock bulled his way into the pile today, announcing an EO that
masks are MANDATED as of today. No end in sight. I think he’s trying to beg some support for his ongoing campaign of becoming our next Democrat senator.

He’s lowered his ambitions by just a wee bit. He was trying to run for President as well. He managed to make it to the debate stage a couple of times but got washed out very quickly.

Well here’s a bit of hopeful news for the morning!

I have wondered why no one is challenging these mask orders on constitutional grounds. I hope this is the first of many. Heck, probably about 90% of the “orders” of these demented governors and mayors, which shut down businesses, locked people in their homes, and ruined their lives and those of their children, were flatly unconstitutional.

It’s late but there’s still time to start challenging this, particularly since they seem to be trying to rev up the shutdown again.

Once, it was “mandated” that negroes sit at the back of the bus in Alabama.

One woman said to herself, “This is bullshit” and ignored the “mandate”.

We need millions of new Rosa Parks to engage in the civil disobedience that is at the core of our “government of the people.”

No matter what the sign says, walk in without a mask and make them confront you. This simple act, repeated millions of times daily, will show the elites and the tinhorn politicians that they really have no power other than what we allow them to have —-a first step in taking our country back.

The rights guaranteed under the Constitution and our (formerly) unalienable rights must be enforced -- at the federal level if necessary and in many Democrat/Left-controlled states this appears to be necessary -- now! Waiting (hoping is more like it) until the first Tuesday in November to do so may prove fatal to our Republic.

I suspect that if this is not addressed promptly, the apparently omnipotent governors -- mostly, but not limited to, Democrat/Left governors -- who think they have unchecked power to suspend Constitutional rights and, without any legislative or judicial action, control the lives of hundreds of millions of American citizens will, following Trump's re-election, "punish" voters by commanding their periodic lockdowns and by maintaining the elevated level of fear, distrust, depression and anger among the citizens of "their" states for the next four years!
