The Florida Supreme Court on Thursday knocked a proposed constitutional amendment to ban possession of assault-style weapons from a prospective berth on the 2022 ballot.
In a 4-1 decision, the court ruled Ban Assault Weapons NOWs 75-word ballot summary affirmatively misleads voters by contradicting broader text in the proposed amendment.
Specifically, the next-to-last sentence of the ballot summary informs voters the initiative exempts and requires registration of assault weapons lawfully possessed prior to this provisions effective date when, in fact, the initiative does no such thing, the majority opinion said. Contrary to the ballot summary, the initiatives text exempts only the persons, meaning the current owners, possession of that assault weapon.

YAAAA!
All weapons are ‘assault’ weapons....................
The wording of the proposed ballot initiative was the issue.
"Misleading is what they do. So, will it move up the road to D.C. and SCOTUS?"
No. It's not a federal issue. It's an issue about the wording on the ballot.
LOL! And, ‘unarmed’ does NOT mean ‘undangerous’.
I can ‘assault’ someone with a stick...................
I doubt it has any life left it, precisely because the finding was that the proposed amendment itself contained materially misleading statements. Appeals have to be grounded in law. Pretty hard to argue a ruling of “self-evident bag of deliberate lies”.
More likely the Florida gun banners (ex-NY and NJ who can’t wait to ruin another state?) will have to start over after being exposed as frauds, and rioting that reminded even idiots why we need high capacity semi-autos for self defense.
read the other day a Florida mayor has suspended people’s right to buy any guns- declaring the state to be in a ‘state of emergency’- I’ll see if i can find the artcle
BREAKING: Florida Mayor Declares State of Emergency In Wake Of Protests, Temporarily Bans Gun and Ammunition Sales
NY and i believe other states used the excuse of ‘imminent need’ to severely restrict gun sale and gun ownership, and gun features- Now Florida mayor is using the excuse of ‘state of emergency’ to try to justify his violating the constitution-
There should be fines for states that ram through legislation that violate the constitution - massive fines- States can cite companies hundreds of billions of dollars fro violating laws- states should be obligated to obey the constitution and not violate rights
IN NY- the fictional ‘imminent need’ must be permanent now? Because i believe they still are under the constitution violating ‘safe act’
Don’t worry. They will change the word ‘assault’ if necessary.
