Supreme Court Decision on DACA Expected Soon
Center for Immigration Studies ^ | 12 May 2020 | John Miano

This is one of the few cases I have seen where the amicus briefs make a much better case than the parties' briefs. In fact, the government's defense of DACA rescission has been so pathetic that one might suspect the deep state within DHS has been sabotaging Trump all along.

This is a long essay, but it gives a reasonably good summary of the case history and the primary legal issues.

My own opinion is that Trump has never wanted to deport the DACA kids or their parents, and that Trump has been complicit with the pro-Amnesty lawyers at DHS since the very first day of his Administration.

My Bottom Line...

Trump's strongest argument has always been "8 U.S.C. §1182(f)" - but Trump refuses to use it in this case.

"Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate."

I agree.

Predition: Roberts will betray us again. 5-4 in favor of DACA retention.

DACA is an executive order invention. I do not believe any of the five “conservatives” could invent a reason to make it law beyond the President’s reach.

Don’t blame Roberts. The cartels paid big money to build their distribution network in the US and they expect DC to stay bought.

Of course they have.

BOTH parties wanted the Kenyanesian Usurper to make new law.
That’s why the GOP would not sue to stop DACA before it got started.

DACA was never legal.
If the court finds anything else, you’ll know we no longer have the rule of law.

Well, if the judiciary can legislate from the bench, the president can legislate voter picture ID for voting in a national election.

Of course there are Swamp Creatures in the Federal government determined to hurt the President. In fact I'm convinced that these creatures constitute the majority of government paycheck recipients.

This decision is likely to be 5-4...but other than that nobody can predict.

Deport all illegals (other than DACA) first...

Stop anchor babies

Restrict legal immigration from everywhere

American jobs for Americans... make it a law...

Finish the above - then sweat the small stuff...

Re: “Does your Anti-Trump snark NEVER end?”

Correct.

Immigration has been my number one issue since the Bush/McCain Amnesty in 2005.

Trump has been a habitual liar on the immigration issue since 2015.

It’s a pretty simple math problem, actually.

New immigrant citizens vote 75% for the Democrat Party.

Bottom Line...

When you get out voted in a Democracy, nothing else matters.

Its NOT a law so this should be easy.
Write a law, signed by both houses and signed by the President.
I learned this from Sesame Street, School House Rock.

I understand where you’re coming from. We clearly need to get him out of office and replace him with a DemocRAT who will close down the southern border and who will appoint judges who will not be enabling the illegal alien onslaught. Of course it’s always possible that the new DemocRAT President won’t govern like that. /sarc

Of course, alternatively, we could reelect President Trump, elect a Republican majority (with a new Majority Leader who would actually not sabotage Trump’s agenda like Paul Ryan did) in the House and get a Senate Judiciary Committee Chairman who would no longer tolerate DemocRAT Blue Slip blocking of desirable DISTRICT Court judges. But these actions may not fit your antiTrump jihad.
