The debate is whether Title VII's protections of discrimination "because of... sex" applies to sexual orientation and "gender" expression.
Does a man who claims to be a transwoman actually get protections based on "sex" when his sex is male?
The liberals are solid for answering "yes," of course.
And chatter in conservative legal circles is that Justice Gorsuch will join the liberals.
There is a rumor rapidly circulating in legal conservative circles that Gorsuch is going to side with the liberals and read transgenderism into Title VII.
I’m a longtime Gorsuch skeptic, but this would certainly be an unprecedented betrayal.

We have had a slim conservative majority on the court for a while, the only way Liberals win is by having a deflection from our side. It is the only way they can win and it does happen and is a big deal
When we win with our majority and a lib or two join in, it isn’t a big deal since we won anyways without them. Sometimes the decision can me unanimous as well.

Fake textualism if true. Let’s hope Gorsuch is above such things.
Firstly, such a SCOTUS decision will drive R voters to the polls. It may also prompt many traditional D voters to vote R. That would give the House back to the Rs, and so make it possible to rewrite Title VII (among other things.)
Secondly, if a precondition is that a claimant must have been fully transitioned phsically in order to qualify, that would exclude all claims based solely on psycho-emotional whim of the moment. There just aren’t that many people who’ve had the full procedure.
It should be noted that, eventually, it will become technically possible to actually change one’s biological sex at the genetic / molecular level. The rumored precedent is probably appropriate for such people.

There are many conservative women who do all kinds of school sports. Some in my own family. You’re saying they should be forced to compete against trans men. The feminists want that. You’re taking the feminist position - against non-feminist women.
