I'd say that it's unconstitutional. Declaring was is NOT the same thing as making war.
IIRC, Nam was not declared. Korea was not declared

Have we declared a war since WWII? Don’t think so. Oh, and I was told Nam was a police action. Since I got my butt nearly blown off there and spent four months in the hospital, I thought it was a war, but later found out it was only a police action. I guess I was doing my part of the policing in the southside of Chicago!!!
