Trump lawyers respond to articles of impeachment: 'Constitutionally invalid'

President Trump's legal team on Saturday issued a full-throttled defense to the articles of impeachment, refuting the substance and process of the charges while accusing House Democrats of engaging in a "dangerous attack" on the right of the American people to freely choose their president.

"This is a brazen and unlawful attempt to overturn the results of the 2016 election and interfere with the 2020 election now just months away," said a source close to the president's legal team, reading from the expected legal filing.

The legal paperwork is the first formal response to the two articles of impeachment read in the Senate on Thursday for abuse of power and obstruction of Congress.

Trump's lawyers argued that the articles of impeachment violated the Constitution and are "defective in their entirety" because they were the product of invalid House proceedings that "flagrantly denied the President any due process rights," a source close to Trump's legal team said Saturday in briefing reporters.

At the crux of Trump's defense is that he did nothing wrong in his July 25 phone call with the president of Ukraine when he asked for investigations into Democrats. Trump's lawyers argue that military aid to Ukraine was ultimately released without any announcement of investigations into former Vice President Joe Biden and his son, Hunter Biden.

I knew this would happen. Putting Ray, Starr, Dersh et al on the same team was because many of them were directly related t the Clinton impeachment, where there were real charges that had places in the Criminal Code.

None of the Democrat charges against Trump had actionable crimes (like for this charge, if guilty, there would be this or that punishment). The SCOTUS should throw it out as illegitimate. Wouldn’t that start a reeee fest?

Why did Trump’s lawyers wait for the Articles of Impeachment to cry constitutional foul? Hell, the investigation from the start was unconstitutional violating the 4A’s requirement for reasonable suspicion and probable cause to launch and continue an investigation.

Hell, it’s harder for for a cop to make a traffic stop than for these degenerate Leftist Dems to impeach a President.

The Senate should order a DIRECTED VERDICT (no genuine dispute of a material fact) and be done with it as Trump laughs all the way to a 2020 landslide victory.

Impeachment is a political process. There is no guarantee of due process.

It can’t be unconstitutional. Unsavory, overreaching and setting a terrible precedent? Yes. But not unconstitutional

Yeah, I agree. If Bush had put in another Thomas instead of Roberts, this impeachment would already be out on it’s tail.

I think our Founding Fathers would disagree with you. They expressly put "high crimes and misdemeanors" into the language specific to impeachment precisely to avoid situations like this one.

The fact is, Democrats cannot impeach President Trump because they don't like him and how he conducts himself. Too bad, so sad.

This entire "impeachment" shouldn't even be allowed in the Senate. Don't give it a single shred of credibility, period.

Denial of due process is unconstitutional. A majority of Congress may not deny them to someone they dislike to get them.

The Constitution doesn’t give Congress absolute powers to do whatever it wants.

If you take that position, impeachment is just another political weapon.

Since Pelosie hammered the thought home that President Trump will have to live forever that he was impeached by the Democrats they why not just elect to have no hearing in the Senate and just dismiss the articles of impeach within the couple weeks.

Ask yourself, what is this coming circus 2.0 really about? If Republicans are willing to drag the President through a fiasco of a trial based on a clear hoax, they can not be on his side. Is this just the latest example of Republicans selling themselves out, and this time along with the President, to prove to the world they are more worthy, righteous, and upstanding than their corrupt liberal colleagues?

The constitution puts the complete power to impeach and define the tiles of the process to the congress. Further it does not define the terms high crimes and misdemeanors. The terminology, along with the word impeachment itself was known through British law/tradition. It didn’t mean a literal indictable crime.

It is absolutely a political process and has nothing to do with due process rights. Due process relates to criminal proceedings, not political ones.

The reason I said that it is a dangerous precedent is exactly because this is absolutely a political hit. But so was the impeachment of Andrew Jackson.

It’s too late now. Pelosi gave DJT’s lawyers 28 days to bring an expedited appeal to SCOTUS and there is no record they even tried to bring a petition.
