A Question of Democratic Senator’s Conflict of Interest. I am sure the President’s Impeachment Team will raise this Question... ‘how may an Active Democratic Candidate running for the Office of President of the United States of America be able to fairly sit in Judgement and cast a Vote in an Impeachment Trial of the incumbent Republican President on Trial? Is this not a ‘Conflict of Interest’ that may affect the Outcome of a Presidential Election? For Ever Vigilant.

You are reading the clause wrong. The senate, if they convict, “MAY” remove from office and “MAY” disqualify him from holding any office. A prime example is Rep. Hastings, (a former judge), who was convicted and removed but not excluded from holding “office”.

The house has no say in what punishment the senate can impose since the senate has sole authority to hold the trial and determine the punishment, (just as a prosecutor can’t force a judge to sentence the defendant to a specific punishment after a guilty finding, neither can the house).

POTUS has a great team of lawyers but unfortunately McConnell and the useless GOP Senate will be running the show.

It would not surprise me at all if the GOP Seante deny POTUS his witnesses while accomodating the Democrats. McConnell will just say in private he doesn’t have the votes for Biden, etc. and POTUS will be painted into a corner. Trump will then be forced to either 1) don’t ask for his witnesses or 2) risk a humiliating election season impeachment witness vote defeat when Romney and the girls vote against him. What a mess.

We all need to remember that President Trump is a billionaire. RINO’s might damage his administration or even end it. I for one would not want a billionaire pissed off at me. Bloomberg does this crap to people because he is nuts, Trump would do out of righteous indignation.

Agree. Unlike Romney and the rest POTUS is a winner.

Rand is hinting at individual votes for each witness. That would be an unmitigated disaster if McConnell allowed the GOP mavericks room to undermine a GOP POTUS impeachment trial. I think McConnell has got his finger in the air and trying to figure out how much he can get away with. No need to wait to next week to give us good news.

True, but the Articles of Impeachment that the House passed do that. Both contain the sentence "President Trump thus warrants impeachment and trial, removal from office, and disqualification to hold and enjoy any office of honor, trust, or profit under the United States." So if convicted Trump would be barred from future elective federal office. The Hastings articles contained no such clause.

But this is not a criminal trial. If the Senate votes to convict, and we all know they won't but if they did, then they basically are voting to accept the impeachment articles that the House sent them, sentence for sentence, clause for clause. And if those articles contain a ban on future office then that ban stands.

Nope. The senate rules require a vote on conviction and, if convicted, then he is removed and finally a vote on exclusion from holding official office.
