This legal precedent of ferae naturae is based on the conclusion that indigenous species, like the brown recluse, are native to the land where the property lies. However, there is no legal precedent from an indigenous animal attacking or biting a person indoors.

Too bad spiders can't read law books or it would have know to stay outside.

It’s Texas. Brown recluse spiders are ubiquitous. In Kansas we lave learned to avoid them, like rattlesnakes.

I used to work in a place that had Brown Recluse Spiders all over the place.

One employee was bitten and lost the end of his finger.....................

My brother died from a recluse spider bite, and the subsequent horrible care he received at the VA.

I read someplace that you are never more than five feet from a spider at any point during your daily activities.

This lawsuit is ridiculous.

Having been bitten he has my sympathy but dude, it was a spider.

If the man was raising them you would have a point. As they are a naturally occurring pest common to the area you have no more claim then you would if you got malaria from a mosquito bite.

Ohio had a SC ruling that said rain, ice, and snow are known hazards so property owners are not liable for slippery conditions and do not have a burden of care to warn people about them.

Common sense... isn’t so common anymore

I was bitten by a Brown Recluse spider 22 years ago on this inside of my thigh.

It hurt at the time, but I thought it was no big deal until the next day when there were giant red/brown/black lines running from the bite to the tip of my toes and up my chest.

They put me on a drip antibiotic; almost died of sepsis.

Still a nasty scar.

For Texas residents, from my city web site "Living with Wildlife"

Raccoons, opossums, coyotes, bobcats and snakes call this area home, as do you. Generally, they are only trying to survive in an ever-changing environment. You can take steps in your yard and home to deter visits from these animals...

Seems terribly silly IMO. Every human habitation has spiders, some of which are venomous. Even if an adult is bitten by a brown recluse, the vast majority of the bites are non-events medically speaking. Most people bitten don’t even realize it or notice a small red bug bite that might itch some. Only a small percentage of bites go on to tissue death or more serious consequences.
