Democrats are going to try to “Kavanaugh” the Impeachment Trial with new accusations

Schumer did that again today with his demand for a “fair” trial, meaning to Schumer that Democrats get to reopen the investigation of Trump during the trial, including calling witnesses who did not testify, and doing the job the House Democrats failed to do. A do-over.

That’s not usually the way trials work — the pleading of claims and discovery takes place before the trial. House Democrats chose not to do that for key witnesses they wanted — including John Bolton and Mick Mulvaney — because forcing them to testify in the House would have meant court litigation. Democrats were on a timetable driven by the 2020 election that did not allow for a court to decide the clash of branches, so they went with what they had.

Schumer and Senate Democrats know that what the House had is not enough to get 20 Republican Senators to vote against Trump — they may not even get one. So the trial takes on a different purpose — to seek evidence and to prolong impeachment investigations for the remainder of the election year based on “new evidence” discovered during the trial.

A Media that wasn't a total tool of the Democrats would have noted that Chuck Schumer had THREE BITES at the impeachment apple in 1998-1999.

Once in the House Judiciary Committee, where he voted "Nay".

A second time in the vote of the full House, where he voted all "Nays".

And a THIRD time after he was elected to the Senate in 1998, and seated in 1999. He voted all "Nays", of course...

How do you go to trial with evidence you didn’t provide?

You guys didn’t charge him with anything meaningful, in that there was no charge of having committed a crime, or evidence provided to prove he did.

The House had it’s chance. That chance is over as soon as it votes to impeach.

Honestly, the House Leadership has really failed it’s duty.

Seems to me a dismissal is in order.

A judge would look at the charges and evidence, and simply toss the case out of court.

There’s no basis for impeachment. Just toss it...

I agree!!! I have heard the arguments both ways, for a Senate Trial and to just shut it down....I am inclined to hope that they just shut it off and move on....

Try? No. They WILL make accusation by innuendo, speculation, and all form of dishonesty. This has been going on for years. Example: “Russia, if you have the files, release them” is held out as proof of being an election-throwing conspiracy with a foreign power.

Is Schumer going to produce some floozies who misremember getting near-raped at college keggers?

I was definitely on the side of forcing Democrats to testify before hostile questioners but now I think it’s better to just reject the entire thing in one swift vote.

McConnell can say that the evidence provided by the House is simply too weak to try and the case is being put to the Senate so deep in the four-year term that it is unfair to presidential candidates of *both* parties to have a prolonged trial.

In addition, they can cite the polls that show clearly the American public is not behind removing the president from office and their general mood is that this is a partisan waste of time that simply needs to be rejected so both houses can move on to other business.

If McConnell is smart, (I think that PDJT’s team will force it), he will allow PDJT to subpoena his witnesses but will tell the House managers that they had their chance to subpoena Bolton et. al. in the House during their hearings, (and fight it out in the courts), but did not take the opportunity so they will have to present the case they came to the Senate with.

The “Grand Jury” phase is over and it is now time to present your case to the jury. No untested testimony at the last minute will be allowed.If the case is weak, (as it is), then you lose. Tough luck.”

I see Schumer’s demand as just another step in the plan worked out months ago for this sham. That is why they would not go to the courts in the House inquiry; they knew they would try this and scream “fixed” trial.

Don’t give in. Only defense witnesses can be called and the House can recall any of their inquiry witnesses only if they meet the “no hearsay”rules of evidence.

Mitch should tell Schumer;

“You know, you make a valid point that the house failed to elicit evidence to support the Articles of Impeachment and that Bolton et. al. may actually have information/evidence to support your Articles of Impeachment.

Therefor, the Senate will return the Articles of Impeachment to the House as “incomplete” with a demand that they provide the Senate with a complete record for impeachment, to include the testimony from the witnesses you have identified.

That will, of course, require that the House allow the president and the witnesses to avail of their rights to bring the dispute to the courts for a definitive decision on the privileges claimed.

When they have done that the senate will accept the revised Articles of impeachment.

However, if you do not agree that my proposal is fair, reasonable but you instead declare it to be unacceptable to you and your caucus, then, the Senate will proceed with the trial, allow PDJT to present his fact witnesses and witnesses to impeach the house witnesses along with any documents he wishes to present to the “court”. The House witness statements that are not ruled inadmissible because of hearsay will be read into the record and the Senate will then vote on impeachment of PDJT.”

CHECKMATE!!!!
