I just watched a Turley interview by CBS from September. He sounded like, though they didn’t yet have a case at that time, if they were able to prove the QPQ, they would definitely have a case.
Problem is, they haven’t so he’s wondering why they are still at it. One thing funny was he said they may have pro-quo, but they don’t have quid. :)
You can take a round peg, a square peg, and a triangle peg and stick them in the matching holes. You cannot stick them in the wrong holes, they just will not fit. It takes all three and they just do not have it, they just don’t have the intelligence to find the right holes.
But a Monkey could do it... :)
