The FBI was in on it.
Once the scorned wife got wind, she made enough fuss something had to be publicly done. Note that Trump is possibly going to be removed from office over a common political move and the FIB is still playing games.

The FIB [sic] doesn’t care about corruption within the ranks. I honestly don't know how a conscientious judge could not view any case brought to him by the FBI with a jaundiced eye. And I don't get the impression that things are improving under Wray.
