They would have to stand the entire system of government on it’s head. They would have to rule that an unconstitutional MEMO by Obama cannot be repealed by an EO by Trump. In essence saying that Obama created a law through an unconstitutional method but they are okay with that.

If the Supreme Court upholds the clearly illegal DACA, then the rule of law is undeniably dead. But the Rule Of Memo will be quite alive.
