Joe DiGenova, on his usual Monday appearance on WMAL dropped a real bombshell. It will make you mad, but explain a lot of stuff we're seeing now.

As Mark Levin points out (on a different topic but the logic should apply all the same) the objection would be made, but then the Senate can vote using only a 50% majority to over-rule the decision.

Whether they go such a route, we shall see.

I put the odds of impeachment at 80% or so, because the House would look absolutely ridiculous to go through all this only to fail to file articles.

But once it gets to the Senate, they can call whatever witnesses they want. Personally, at this moment in time, I think they should dismiss the charges immediately. But there is something to the logic of using the impeachment for political advantage. The Dems sure are using it for politics. The Senate can turn the trial into a spotlight on Democrat political corruption. Trump’s call asks for 2 favors: Investigate crowdstrike, and find out about this Hunter/Biden bribery of Ukraine. Why did Trump link the two? The House wants to focus on one thing, but the record begs the question why did Trump in his mind link the two issues. If there is a legitimate law enforcement question or corruption issue they should get to the bottom of it.

Article 1, Section 5 - Each House may determine the Rules of its Proceedings.

The rules of the Senate are whatever the Senate says they are. Just as Pelosi and Schiff are dictators in the House, similarly McConnell and his Committee Chairmen are dictators in the Senate.

we wouldn’t be here if the GOP had shut down Mueller the minute it was known Clinton/DNC funded/created(?) the fake Russian dossier... and set up an investigation of the spy-gaters and coup-plotters.

Linking those two things together creates a much larger playing field. Ukraine can investigate one, produce a finding on that specific thing and that’s it. Knowing that all of these people were/are in cahoots with each other and were going to profit off the whole thing, his request is one YUGE net to get all of them.

That’s a pretty legit strategy.

Too many compromised Never Trumpers in the Senate. Anything done there on this is risky, because one manipulative media blowup could give them enough cover to strike.

It’ll likely blow over without consequence, but the risk of Trump’s actual removal is there and shouldn’t be played with.

Not getting into the weeds on the issue of the day, BUT …

House rules and Senate rules are two different creatures, institutionally and culturally. All 435 members of the House are elected every two years. The House reconstitutes itself and adopts its rules every two years. On the Senate side, however, only one third of Senators stand for election each cycle. Two thirds carry over. The Senate therefore regards itself as a continuing body whose rules, originally written by Thomas Jefferson, carry forward automatically without being readopted every two years. Over 200 years, this has given rise to a very different institutional culture surrounding the rules and potential changes to the rules. It is why, for example, the Senate typically proceeds by unanimous consent on procedural matters. That doesn't mean that Senate rules can't be changed. It does mean that there is no automatic, built-in point at the beginning of each session at which rules changes are in order. Mitch McConnell can't just snap his fingers and order up a new rule. The cultural barrier to rules changes is much higher in the Senate.

Like his previous 158 "bombshells" in recent months.

He and Hannity are walking "bombshell" machines.

What was the "Big One" Joe? Was it that months ago the FISA would be declassified "this week"? Then "next week"? Then "Durham is about to act"? How about "Barr has had enough"? Or was it "Graham is going to hold hearings"?

I just can't keep one "bombshell" straight from another these days.

The biggest laugh line is his "The great men and women in our Department of Justice and the FBI."

Rigght. Keep spewing that Joe.

The Senate could change the rules,subpoena the witnesses but how to they physically force a witness to appear or answer any question?
