Supreme Court appears inclined to let Trump end DACA Program

WASHINGTON — A bare majority of the U.S. Supreme Court appeared likely Tuesday to let the Trump administration follow through on its plan to shut down DACA, the federal program that has allowed nearly 800,000 young people, known as dreamers, to avoid deportation and remain in the U.S.

With hundreds of DACA supporters rallying outside — so many that police shut down the street in front of the Supreme Court — the justices heard nearly an hour and a half of oral arguments. Based on their questions, it appeared that the court's five conservatives were inclined to rule that the Department of Homeland Security acted properly when it ordered the program ended in 2017 and that the federal courts cannot second-guess that decision.

While Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, and Brett Kavanaugh appeared likely to say DACA was properly shut down, Chief Justice John Roberts did not seem to be as strongly convinced. Roberts may be the deciding vote, just as it was last term when the court blocked the Trump administration from adding a citizenship question to the 2020 census form. He concluded in that case that the government did not give an adequate explanation for its proposed action.

If it is not ended then the SCOTUS is ruling that there is no need for a legislature and no need for laws.

I’ve been through this enough to know that their questions don’t really indicate the way they are leaning to vote. Been fooled before!

But yeah, I agree with everyone posting hear about Roberts.

DACA was part of the Obama/Clinton plan making her election a dead lock. All of the DACA spawn need to GTFO and go back.

That, sadly, was what I thought of when it was clear that the phrase “bare majority” really makes no sense no matter how NBC tries to make it seem like it might.

Unlikely that they did. Chief justice looks like a fellow traveler.

DACA was clearly illegal when instituted. It’s disgusting that there is any debate on whether a real POTUS can end an illegal program.

So then what's with this?

Trump claims he'll strike deal for Dreamers with Dems if SCOTUS overturns DACA

He doesn't really think he can strike a deal with the Democrats, does he? Especially in an election year?

Yeah, Washington’s first EO was “Chef Louis, Steak and Asparagus on Fridays”, Admas first one was “Chef Raoul, New England Clam Chowder on Fridays, hereby rescinding Mr. Washington’s EO”.

Could the SCOTUS handle that one?

Not only that, Obama’s DACA was illegal.

As I said in post 44, it’s what he does (makes deals). A deal would likely get him reelected, despite the kicking, screaming and temper tantrums that would be displayed here on FR. But, more likely, he will push a bill that gives amnesty to the dreamers, and the left will reject it, AGAIN leaving the dreamers as political pawns. Trump can paint the dems as “putting the interests of illegal immigrants, criminals and drug cartels, over those of the dreamers”.

Trump does not need to “end” DACA.

All he has to do is write an Executive Order that commands the Secretary of Homeland Security to enforce the law, exactly as it is written in the Immigration and Nationality Act.

Such an Executive Order cannot even be reviewed by a federal court, according to the exact language in the Administrative Procedure Act.

The “D” in DACA stands for “Deferred Prosecution.”

Trump is the Chief Executive Officer of the Department of Justice.

He can stop Deferred Prosecution any time he wants to.

This lawsuit is a total time wasting scam.

Bottom Line...

Trump does not want to deport any DACAs unless they have committed serious crimes.

I repeat myself - this has always been a politically motivated lawsuit that Trump hopes will not become a huge issue before he is reelected in 2020.

If Trump is reelected, he will offer Amnesty to the DACAs in exchange for his Border Wall, etc.

If the Democrats refuse, Trump will do nothing.

Not one DACA will ever be deported while Trump is President unless that person has committed a serious crime.

Yes. The degree of a majority matters.
