Supreme Court appears inclined to let Trump end DACA Program

WASHINGTON — A bare majority of the U.S. Supreme Court appeared likely Tuesday to let the Trump administration follow through on its plan to shut down DACA, the federal program that has allowed nearly 800,000 young people, known as dreamers, to avoid deportation and remain in the U.S.

With hundreds of DACA supporters rallying outside — so many that police shut down the street in front of the Supreme Court — the justices heard nearly an hour and a half of oral arguments. Based on their questions, it appeared that the court's five conservatives were inclined to rule that the Department of Homeland Security acted properly when it ordered the program ended in 2017 and that the federal courts cannot second-guess that decision.

While Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, and Brett Kavanaugh appeared likely to say DACA was properly shut down, Chief Justice John Roberts did not seem to be as strongly convinced. Roberts may be the deciding vote, just as it was last term when the court blocked the Trump administration from adding a citizenship question to the 2020 census form. He concluded in that case that the government did not give an adequate explanation for its proposed action.

Another slanted, poorly written article from the left.

If we are counting on Roberts to side with the constitution, we are likely to be disappointed.

IF the court gives Trump a victory, the question is “what will he do”? Many here at FR act as if these “dreamers” will be deported, but that is NOT gonna happen. IMHO, Trump would use a win to try to force Congress to spend the election year crafting a “comprehensive” immigration bill. He might even have a bill ready to go that he can submit to them. Whatever ends up on Trump’s desk, it will NOT make most here happy, and WILL include some level of amnesty, but hopefully not a path to citizenship or importing families. Trump makes deals. It’s what he does.

Then the question is “do Democrats again turn down a deal for the dreamers”? Do they give up their campaign issue? Do they piss off the voters by refusing to make a deal that Americans, if not Freepers, largely support? It seems either choice helps Trump, though the media will distort and mislead, as always. Is this a big part of Trump’s calculus to win reelection?

Wow. Not on my watch.
Those gainfully employed without criminal records, paying taxes not on social services maybe should have a permanent resident alien and their children can apply for citizenship at age 21. That would be as far as I would go. And they have to pass oral & written tests of ability in English language.

If a program can be started by Executive Order, it can be ended by Executive Order. End of story.

This should be a 9-0 decision.

“If one President can act by executive order, it would be completely ridiculous that the next president cannot undo it in the same manner. If Trump cannot end it, the court would have to nullify Obama’s actions as also unconstitutional. There is no other logical outcome.”

Stop making sense. We are talking about the current state of the American judiciary here.

New Data Shows Criminal Arrest Histories of DACA Requestors

U.S. Citizenship and Immigration Services (USCIS) released new data regarding arrests and apprehensions among the Deferred Action for Childhood Arrivals (DACA) requestor population. The data contains both criminal and civil information of those approved and denied under DACA.

Almost 8-percent of total DACA requestors (59,786 individuals) had arrest records as of the date the systems were queried, which included offenses such as assault and battery, rape, murder, and drunk driving, among others.

Of those individuals whose DACA requests were approved and had one or more arrests or apprehensions, 53,792 were arrested or apprehended prior to their most recent approval.

Approximately 13-percent (7,814) of approved DACA requestors with an arrest had an arrest after their grant was approved and prior to renewal.
Of the total 888,765 DACA requestors, 797,297 had no arrests or apprehensions, and 710, 842 were approved.
