Supreme Court appears inclined to let Trump end DACA Program

WASHINGTON — A bare majority of the U.S. Supreme Court appeared likely Tuesday to let the Trump administration follow through on its plan to shut down DACA, the federal program that has allowed nearly 800,000 young people, known as dreamers, to avoid deportation and remain in the U.S.

With hundreds of DACA supporters rallying outside — so many that police shut down the street in front of the Supreme Court — the justices heard nearly an hour and a half of oral arguments. Based on their questions, it appeared that the court's five conservatives were inclined to rule that the Department of Homeland Security acted properly when it ordered the program ended in 2017 and that the federal courts cannot second-guess that decision.

While Justices Clarence Thomas, Samuel Alito, Neil Gorsuch, and Brett Kavanaugh appeared likely to say DACA was properly shut down, Chief Justice John Roberts did not seem to be as strongly convinced. Roberts may be the deciding vote, just as it was last term when the court blocked the Trump administration from adding a citizenship question to the 2020 census form. He concluded in that case that the government did not give an adequate explanation for its proposed action.

Why would one president need a Supreme Court ruling to be able to end a former president’s program?

Of course he can. It’s not even a question. Obama doesn’t get to rule forever by executive fiat even when he’s no longer in office.

So then why would the Democrats make one?

But, more likely, he will push a bill that gives amnesty to the dreamers, and the left will reject it, AGAIN leaving the dreamers as political pawns.

The Dems will say Congress already passed a bill protecting the Dreamers and all Trump would need to do would be to get the Senate to pass it and for him to sign it. You're right in that the Dreamers are nothing but a a political pawn for both sides, but I don't see where Trump has the upper hand in it.

Roberts is a liberal justice, GWB knew when he was nominated that he was a liberal justice GWB was NOT a conservative and never has been!!! ANYONE here who does not know by now that Justice Roberts is a liberal justice is living in LA LA LAND!!! We all need to realize that the SCOTUS is 5-4 in THEIR favor and PRAY that Trump gets a second term AND Ginsberg bites the bullet!!!!

Such an Executive Order cannot even be reviewed by a federal court, according to the exact language in the Administrative Procedure Act.

While most of your post is reasonable, the above is laughable in today's judicial climate. The courts stick their noses into issues like this every day. Border security, energy policy, medicare rules, ACA rules, immigration policy, you name it, judges have opposed, and over 90% of the time stopped the Trump administration from implementing his agenda. Even this case is saying the POTUS has no authority over his own executive branch. And don't forget, it was Roberts who decided the census citizenship case by effectively saying "sure the question is legal, but you didn't explain your reasons well enough". Replace "cannot" with "shouldn't" and it's true, but there are activist judges in every judicial circuit that are willing to disregard the law and the constitution, and the left has them on speed-dial.

Telling the current President he can’t rescind a previous President’s executive order would blatantly violate separation of powers. The USSC is not going set up a fight where it claims supremacy over the Executive or legislative branches, over their explicit powers. Especially when the court gains nothing for it.

Since none of us can actually work together, and there’s no such thing as ‘loyal opposition’ anymore, we undermine one another when power switches hands.

So...let’s make sure we grind the ‘Rats to DUST come 2020 and beyond, shall we? MAGA! KAG!

Because they’ll do all manner of horrible UN-Constitutional things when they get the power back - which they will sometime in the future - unfortunately.

Hopefully I’ll be dead by then, but it could come as early as 2025 because ALL of America and most of the world will be fat, happy and complacent by then, thanks to President Trump. And in THOSE years - the idiot Dems tend to regain power. :(

The Supreme Court said in June that it would hear arguments over Trump’s DACA termination, and a decision by the justices is likely to come next spring or as late as the end of June 2020.
