DACA is wholesale unconstitutional...

However, the supreme court has shown repeatedly that doesn’t matter if they desire an outcome they will invent a way to justify no matter how unconstitutional or abhorrent it is.

Nothing complicated about it.

It was an illegal EO when it was issued at minimum.

Even if anyone agreed it was legal that still doesn’t mean it couldn’t be rescinded.

Could Obama rescind it? Of course he could. If he had said he would do that no one in the Rat party would have dared to stop him.

The only difference is that the name of the President changed.

Trump has every right to rescind it.

No, it should be about the constitutionality of the policy... which DACA is wholesale unconstitutional on its face... but as we have seen repeatedly that doesn’t matter to the court if the ends are what they want they will invent justifications for it.

The Supreme Court is ruling whether Trump can undo an unconstitutional Obama Executive Order. What a perversion of the legal system.

This is what I can't figure out. Didn't the Court already rule DACA was unconstitutional as an EO?

And, if so, how can it be argued that it is unConstitutional to end an unConstitutional program?

It seems to me that there is only one remedy for those who want DACA to continue... and that is for Congress to act and for the President to sign.

Just because that path is unlikely... that doesn't mean that any other alternative will do.

For all the whining and lopsided reporting done on this issue, it is a simple case, and despite what this article says, a Texas judge has already ruled DACA is unconstitutional when Obama was president. DACA is an executive order. Any EO can be eliminated by a following President. There is no congressionally passed and signed law behind DACA.

This one is beyond stupid.

First it was illegal for Obama to do it.

But instead a judge says its illegal to reverse Obamas illegal action.

Supreme may say something like in order for it to be reversed the original order needed to be challenged. Since it wasn’t it became legal. Now the new order was challenged and is deemed illegal because the original illegal order was never challenged.

I agree. Its simply unimaginable that the USSC could do anything but throw out DACA without wrecking the rule of law completely.

This is not a complicated case. The argument at the supreme court should be centered around the constitutionality of Obama’s DACA executive order. It’s not even arguable regarding a president’s power to issue executive orders even if the orders countermand previous orders.
