Prosecution Tells Harvey Weinstein “Unwanted Voluntary Sex” Is Not A Real Thing

The Manhattan D.A.’s office has asked a judge to block Harvey Weinstein’s defense team from calling on a psychologist to testify about false memories and the distinctly Orwellian-sounding phenomenon they refer to as “unwanted voluntary sex.”

In a court filing made public on Wednesday, prosecutors responded to a series of motions made by Weinstein’s legal team, including his request to call social psychologist Deborah Davis to testify about “the accuracy and reliability of memory in disputed sexual encounters,” including “the formation of fully false memories for events that never happened.” Specifically, Davis would testify about the “phenomenon of ‘voluntary unwanted sex,’ i.e., sex that is undesired, but that the person chooses to engage in.”

In their response, prosecutors argued that Davis’ theories have no scientific or legal basis and should not be allowed at trial. They also addressed the Weinstein team’s claim that Davis would act as counterweight to the testimony of Barbara Ziv, MD, an expert called on by the prosecution who has also testified at the trial of Bill Cosby about how sexual assault survivors respond to trauma.

Once Harvey hits the big house, he'll quickly find out what's voluntary and what isn't.

He will be the recipient of a lot of “unwanted voluntary sex.”

I think that only applies to marriage.

“Prosecution Tells Harvey Weinstein “Unwanted Voluntary Sex” Is Not A Real Thing”

So the prosecution has never been married (nor otherwise taken pity on anyone).

Waking up to find someone kissing your neck and running their fingers through your hair feels so good.......unless your are in prison.

Naaah, there's such a thing as "against one's better judgment."

But in the old days, it was the girl saying "I'm gonna regret this in the morning, but OK!"

Now, it's become the girl saying "You're going to regret this in six months once I've talked to the Title IX Kangaroo Court."

Heh. But I think there may be something to the “unwanted voluntary sex” thing - though that’s a stupid term. A lot of starlets and wannabe starlets likely hated the casting couch experience, but they went along anyway in search of fame and fortune. More of an “against better judgment” thing.

I don’t know if he will hit the big house. He’s in a protected class: Big time Democrap donor. To me the only reason he’s been arrested is because Hillary got ticked off that she lost the election so those who failed her must be punished, but I think eventually Weinsteins Democrap card will save him.

This is all nonsense. Psychologists are generally charlatans and what can their theories do to help determine facts?

Another show trial, but a different perp, a different cast of characters, and actual alleged crimes. Thanks Libloather.

lol

“unwanted, voluntary...”

How many of those are there?

I don’t want to go to work some days and i’m not forced to.

I don’t want to do chores some days and i’m not forced to.

And I’m quite sure there have been times when folks were not in the mood for action but did it to please a partner.

THIS GUY is a monster and i’m SURE there is no need for the “unwanted voluntary” performers to put him away.

I’m sure there’s a woman out there that had “unwanted, INVOLUNTARY sex” with him.

Or more than one. That should put him away.

If a woman trades sex for fame, that’s not rape.

I’ve known women that have traded sex for a lot less.

Who comes up with this stuff.
You either agree or not. How one ‘feels about it’ after they agree is not relevant.

In the modern world there seem to be plenty of cases where someone decides years later that they didn't agree to have sex, even though, as has been reported in some of the instances related to Harvey Weinstein, the person he had sex with went to his hotel room, saw him already undressed, decided to stay anyway, decided to get undressed themselves, said OK, lets have sex, and then enjoyed the success associated with their closeness to Weinstein.

But now, many years later, they are arguing that they didn't consent to having sex, and really didn't like the guy at the time, nor really want to have sex with him, but thought having sex with him would advance their career.

You are correct, but that isn't always the standard being advanced in courts and Title 9 hearings today.

That's like Woopie saying Polanski raping a young underage girl is not “rape rape”

I loved when Donald Trump, Jr. threw that one in her face earlier this week on The view.

Junior OWNED The view big time!

Bigly!
