House releases resolution formalizing Trump impeachment inquiry

impeachment resolution that calls for public hearings in which both the chair and ranking Republican on the Permanent Select Committee on Intelligence can call and question witnesses and subpoena documents.

The eight-page resolution appears to address at least some of the complaints GOP lawmakers have raised since the effort began by allowing Rep. Devin Nunes, the top Republican on the committee, nearly as much authority as Chairman Adam Schiff.

Nunes and Schiff “shall be permitted to question witnesses for equal specified periods of longer than five minutes, as determined by the chair. The time available for each period of questioning under this paragraph shall be equal for the chair and the ranking minority member,” the resolution reads.

The House has no legal obligation to be fair. The only reason it ever tries to give that (false) impression is for the purpose of maintaining institutional legitimacy. The people are overdue to reject Congress as a governing body.

That said, this resolution opens as a grant of authority to six named House committees, to conduct an investigation (fishing expedition actually, given the root basis is that phone call with Zelenskyy) into whether sufficient grounds exist for the House to impeach Trump.

What follows is a lopsided investigatory process, but this is typical of all partisan endeavors. This is a partisan witch hunt, based (like Russian collusion) on imaginary wrongs.

Members of Congress can’t be impeached. They can be expelled by a 2/3 vote. They are subject to criminal indictment while in office, unlike the President.

A House Resolution is neither a law nor a rule. Democrats are likely to follow this one, and as such they may find it useful. They can get away with starting out in this way because the Constitution does not precisely state how the House conducts the “inquiry.” Unfortunately, millions of voters will believe what the media says. I hope more of them will see though the propaganda machine.

House Rules are created by passing H.Res.

Existing House Rules are the combination of H.Res. from the 114th, 115th, and current (116th) Congresses.

H.Res.5 and H.Res.693 in the 114th Congress; H.Res.5 in the 115th Congress; and H.Res.6 in the 116th Congress.

Not a single word in these rules, which are extensive including grants of jurisdiction to committees, committee process, etc., not a single word on impeachment power.

There are separate H.Res. when impeachment cases surface. Historically, all of these were started with a basis (like a criminal conviction against a judge, or the Starr report that concluded felonies were committed) that was broadly agreed to be "bad conduct."

I can’t find House Resolutions which defined minority rights of calling witnesses etc. (nonexistent in Schiff’s committee) in the Nixon impeachment preparations. Msybe they were in committee votes instead of House Resolutions?
