Lawmaker Wants To Make Gun-Free Zones Liable If Someone Hurt
CAP CON A Michigan News Source ^ | Sept. 27, 2019 | By Tom Gantert

State Rep. Gary Eisen, R-St. Clair Township, introduced House Bill 4975, which would revoke governmental immunity from lawsuits arising from injuries sustained on government property where guns are banned. Eisen is also the sponsor of House Bill 4976, which would make a government, business or individual that designates a property a gun-free zone responsible for the safety of individuals who enter it.

Eisen said part of the rationale for his bill lies with a report that 98% of mass public shootings happen in gun-free zones. The Washington Post reported that President Donald Trump recited that statistic in a May 4 speech to the National Rifle Association.

The Washington Post said the figure comes from the Crime Prevention Research Center’s updated 2014 report. That report stated that 98.4 percent of mass shootings from 1950 to July 10, 2016, happened in gun-free zones.

“We call them killing zones, not gun-free zones,” Eisen said.

Makes sense to me - why did it take this long to get this going?

Sounds about right to me IF it’s what the law calls a “public accommodation”, i.e., IF the premises welcome the general public to their business/institution.

I think they should be liable.

If you deprive people of the means to defend themselves, then you must assume responsibility for their safety and you are liable if you fail to protect them.

Ping.

I’m still hoping that commercial liability insurance underwriters will soon make “gun free zones” unaffordable, or, better uninsurable.

Excerpts from another blogger that quoted this article is as follows:

Michigan Bill Would Put Gun-Free Zone On The Hook For Injuries (click here)

"The Supreme Court has ruled that the authorities have no duty to protect you as an individual. The police’s job is to protect society as a whole, not you as a person. Honestly, that’s fine with me. While I respect police officers, by and large, I also recognize that the only way they could protect me as a person is to walk side-by-side with me all the time and I’m someone who likes my privacy.

Where this becomes a problem, though, is in gun-free zones.

So far, there are only two co-sponsors on the bill from what I can see, though that might well change. If you’re in Michigan, you may want to reach out to your House representative and tell them you want them to co-sponsor this bill.

After all, if you’re going to be forced to disarm yourself to someone else can have the illusion of safety, the least they can do is put their money where their mouth is. If “gun-free zone” signs are effective, then it shouldn’t matter if they’re liable for injuries, right? Of course, we all know better. More importantly, though, they know better too, which is why I promise you that none of the gun control groups are going to say anything close to support for this bill."

Michiganders, he needs more co-sponsors!

Trouble is, they might make carrying a gun--open or concealed--unaffordable also, if it became a law like auto insurance.

Take heed!

You are correct. Just because I carry concealed that does not mean I don't have to think about where I'm going to go if it puts me in harm's way.

Let trouble come to me on my terms, I'm not going to go looking for it on theirs.

GOOD IDEA.

Take away 2nd amendment rights? Then you must pay for the damage caused.

Uninsurable would be the best route, but a lot of the economy would collapse, I’m thinking.

When it comes to these mass public shootings, there is no guarantee a good guy with a gun will save the day, but without one, the bad guy can just have his way.

If the six dead people at Sandy Hook could have a do-over, you can bet to a one, they would have preferred to have face young Adam Lanza with a gun of their own.

DUH!

If you're a shooter intent on mayhem wouldn't you look for a place with the least chance of injuring yourself?

Joe Biden was the author of the “gun free zone” law.
Bush 41 signed it.
I have mentioned this at least a dozen times and nobody gives a shiff.
